 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to conflicts of interest of Department of Information
 1-9     Resources employees.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Subsection (b), Section 2054.022, Government
1-12     Code, is amended to read as follows:
1-13           (b)  The department shall remove from the bidding process,
1-14     including development of the proposal through award of the contract
1-15     and contract negotiation, any employee who receives more than five
1-16     percent of the individual's income from any likely respondent to a
1-17     bid proposal issued by the department or whose spouse is employed
1-18     by any likely respondent to a bid proposal issued by the
1-19     department.  [A person who is the spouse of an officer, employee,
1-20     or paid consultant of a business entity that has, or of a trade
1-21     association of business entities that have, a substantial interest
1-22     in the information resources technologies industry and that may
1-23     contract with state government may not be:]
1-24                 [(1)  a member of the board; or]
1-25                 [(2)  an employee of the department who:]
1-26                       [(A)  is exempt from the state's position
1-27     classification plan; or]
1-28                       [(B)  is compensated at or above the amount
1-29     prescribed by the General Appropriations Act for step 1, salary
1-30     group 17, of the position classification salary schedule.]
1-31           SECTION 2.  This Act takes effect September 1, 2001.
