 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the responsibility for and allocation of renewable
1-11     energy resources by a generation and transmission electric
1-12     cooperative.
1-13           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-14           SECTION 1.  Section 39.904, Utilities Code, is amended by
1-15     adding Subsection (g) to read as follows:
1-16           (g)  At the election of its board of directors, a generation
1-17     and transmission cooperative is responsible for the cumulative
1-18     total of its cooperative members' renewable energy requirements and
1-19     its affiliated cooperative members' renewable energy requirements.
1-20     The commission may not require a cooperative that elects under this
1-21     subsection to allocate the cooperative's renewable resources
1-22     between its members or its affiliated members when those resources
1-23     are nominated.  This subsection does not affect the cumulative
1-24     total of renewable energy resources that are the responsibility of
1-25     a generation and transmission cooperative, its cooperative members,
1-26     or its affiliated cooperative members in meeting their share of the
1-27     state's goals for renewable energy resources.
1-28           SECTION 2.  This Act takes effect immediately if it receives
1-29     a vote of two-thirds of all the members elected to each house, as
1-30     provided by Section 39, Article III, Texas Constitution.  If this
1-31     Act does not receive the vote necessary for immediate effect, this
1-32     Act takes effect September 1, 2001.
