                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to benefits payable by the Judicial Retirement System of
 1-3     Texas Plan Two.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subsections (a) and (c), Section 839.102,
 1-6     Government Code, are amended to read as follows:
 1-7           (a)  Except as provided by Subsections (b) and (c), the
 1-8     standard service retirement annuity is an amount equal to 50
 1-9     percent of the state salary, as adjusted from time to time, being
1-10     paid [at the time the member retires] to a judge of a court of the
1-11     same classification as the last court to which the retiring member
1-12     was elected or appointed.
1-13           (c)  The standard service retirement annuity of a person
1-14     qualifying for retirement under Section 839.101(b) is an amount
1-15     computed as a percentage of the state salary, as adjusted from time
1-16     to time, being paid [at the time the member retires] to a judge of
1-17     a court of the same classification as the last court to which the
1-18     retiring member was elected or appointed, according to the
1-19     following schedule:
1-20                age at retirement           percentage of state salary
1-21           at least 60 but less than 61         40     percent
1-22           at least 61 but less than 62         41.7   percent
1-23           at least 62 but less than 63         43.6   percent
1-24           at least 63 but less than 64         45.6   percent
1-25           at least 64 but less than 65         47.7   percent.
 2-1           SECTION 2.  (a)  This Act takes effect September 1, 2001,
 2-2     except as provided by Subsection (b) of this section.
 2-3           (b)  Section 1 of this Act takes effect September 1, 2003, if
 2-4     the comptroller of public accounts of the State of Texas
 2-5     determines, after consultation with the actuary for the Employees
 2-6     Retirement System of Texas, that implementation of the change in
 2-7     law made by Section 1 of this Act would not necessitate additional
 2-8     state contributions for the Judicial Retirement System of Texas
 2-9     Plan Two to remain in compliance with Section 840.106, Government
2-10     Code.  The comptroller may also make the determination earlier, in
2-11     which case the effective date of Section 1 of this Act is the date
2-12     of the earlier determination.  If the comptroller makes a
2-13     determination under this subsection, the comptroller shall file
2-14     notice of the determination with the secretary of state for
2-15     publication in the Texas Register.
2-16           (c)  The change in law made by Section 1 of this Act to
2-17     Section 839.102, Government Code, applies to all annuities that
2-18     become payable under Subtitle E, Title 8, Government Code, on or
2-19     after the effective date of Section 1 of this Act.
