No. 1132 By: Armbrister 1-7 A BILL TO BE ENTITLED 1-8 AN ACT 1-9 relating to the retirement benefits of certain law enforcement 1-10 officers in the Employees Retirement System of Texas. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Subsection (b), Section 814.107, Government Code, 1-13 is amended to read as follows: 1-14 (b) The standard service retirement annuity payable for at 1-15 least 20 years of service credit as a law enforcement or custodial 1-16 officer is an amount computed on the basis of the member's average 1-17 monthly compensation for that service for the 36 highest months of 1-18 compensation, times the sum of the percentage factor used in the 1-19 computation of a standard service retirement annuity under Section 1-20 814.105 plus: 1-21 (1) .5 percent for service credit as a custodial 1-22 officer; 1-23 (2) .5 percent for service credit as a law enforcement 1-24 officer, unless the member qualifies under Subdivision (3); or 1-25 (3) .75 percent for service credit as a law 1-26 enforcement officer, if the total amount of law enforcement service 1-27 credited is 30 years or more and at least three years of that 1-28 service occurs after August 31, 2001. 1-29 SECTION 2. This Act takes effect September 1, 2001. 1-30 SECTION 3. The Employees Retirement System of Texas is 1-31 required to implement this Act only if the legislature appropriates 1-32 money specifically for that purpose. If the legislature does not 1-33 appropriate money specifically for that purpose, the Employees 1-34 Retirement System of Texas may, but is not required to, implement 1-35 this Act using other appropriations available for the purpose. 1-36 * * * * *
