No. 1144 77R8627 PAM-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the transfer of certain state property from the Texas 1-3 Department of Criminal Justice to Galveston County. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. (a) Not later than January 31, 2002, the Texas 1-6 Department of Criminal Justice shall transfer to Galveston County, 1-7 for consideration to which the parties mutually agree, the real 1-8 property described by Subsection (d) of this section. 1-9 (b) Consideration for the transfer authorized by Subsection 1-10 (a) of this section may be in the form of an agreement between the 1-11 parties that requires Galveston County to use the property in a 1-12 manner that primarily promotes a public purpose of the state. If 1-13 the consideration for the transfer is in the form of an agreement 1-14 described by this subsection: 1-15 (1) Galveston County must use the property transferred 1-16 under this Act in a manner that primarily promotes a public 1-17 interest of the state; and 1-18 (2) ownership of the property automatically reverts to 1-19 the Texas Department of Criminal Justice if Galveston County fails 1-20 to use the property in that manner. 1-21 (c) The Texas Department of Criminal Justice shall transfer 1-22 the property by an appropriate instrument of transfer. If the 1-23 consideration for the transfer is in the form of an agreement 1-24 described by Subsection (b) of this section, the instrument of 2-1 transfer must include a provision that: 2-2 (1) requires Galveston County to use the property in a 2-3 manner that primarily promotes a public purpose of the state; and 2-4 (2) indicates that ownership of the property 2-5 automatically reverts to the Texas Department of Criminal Justice 2-6 if Galveston County fails to use the property in that manner. 2-7 (d) The real property to which Subsection (a) of this 2-8 section refers is described as follows: 2-9 All that certain 36.812 acres of land, more or less, being located 2-10 and situated in the JOHN SELLERS LEAGUE, ABSTRACT 180, Galveston 2-11 County, Texas, more particularly being a part of Lots 2, 3, 4, 5 2-12 and 7 and all of Lots 6, 8, 9 and 10, Block 11, together with an 2-13 intervening 40 foot Roadway Easement, all being out of TEXAS CITY 2-14 GARDENS, a Subdivision in Galveston County, Texas, according to the 2-15 map thereof recorded in Volume 254, Page 11, Galveston County Map 2-16 Records, said 36.812 acres being more particularly described by 2-17 metes and bounds as follows: 2-18 BEGINNING at a 1-3/4 inch iron pipe found for corner and being the 2-19 Northeast corner of aforesaid Lot 2, Block 11, said point being in 2-20 the South line of Industrial Road having a 60 foot right-of-way, 2-21 and further being on the common line of the JOHN SELLERS LEAGUE 2-22 with the JOHN W. LYTTLE LEAGUE; 2-23 THENCE SOUTH, along and with the East line of said Block 11, the 2-24 same being the common line of said SELLERS and LYTTLE LEAGUES, a 2-25 distance of 1926.50 feet to a 5/8 inch iron rod found for corner 2-26 and being at the Southeast corner of aforesaid Lot 10, Block 11; 2-27 THENCE N 89 51'00" W, along and with the South line of said Lot 10, 3-1 at 545.29 feet pass the East line of a 40 foot Roadway Easement 3-2 (not open), the same being the Southwest corner of said Lot 10; at 3-3 565.29 feet pass a 5/8 inch iron rod found on line and being at the 3-4 centerline of said 40 foot Roadway Easement; at 585.29 feet pass 3-5 the Southeast corner of Lot 9, Block 11; and continuing for a total 3-6 distance of 1130.58 feet to a 5/8 inch iron rod found for corner 3-7 and being the Southwest corner of aforesaid Lot 9, the same being 3-8 the Southeast corner of Lot 10, Block 10, TEXAS CITY GARDENS; 3-9 THENCE NORTH, along and with the West line of Block 11, the same 3-10 being the East line of Block 10; at 430.86 feet pass the 3-11 Southeasterly line of a 200 foot Canal Easement to Gulf Coast Water 3-12 Authority as described in Film Code 009-19-1017, Galveston County 3-13 Deed Records; and continuing for a total distance of 745.02 feet to 3-14 a 5/8 inch iron rod found for corner, said point being at the 3-15 Northwesterly line of said 200 Canal Easement, said point being 3-16 SOUTH, a distance of 25.58 feet from the Northwest corner of Lot 7, 3-17 Block 11; 3-18 THENCE N 39 32'24" E, along and with the Northwesterly line of said 3-19 Canal Easement and across Lots 7, 5, 3, 4 and 2, a distance of 3-20 1532.56 feet to a 5/8 inch iron rod found for corner and being in 3-21 the North line of said Lot 2, the same being the South line of 3-22 aforesaid Industrial Road; 3-23 THENCE S 89 51'00" E, along and with the South line of said 3-24 Industrial Road, a distance of 154.92 feet to the POINT OF 3-25 BEGINNING and containing 36.812 acres of land, more or less. 3-26 SECTION 2. This Act takes effect immediately if it receives 3-27 a vote of two-thirds of all the members elected to each house, as 4-1 provided by Section 39, Article III, Texas Constitution. If this 4-2 Act does not receive the vote necessary for immediate effect, this 4-3 Act takes effect September 1, 2001.
