 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the transfer of certain state property from the Texas
1-11     Department of Criminal Justice to Galveston County.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1.  (a)  Not later than January 31, 2002, the Texas
1-14     Department of Criminal Justice shall transfer to Galveston County,
1-15     for consideration to which the parties mutually agree, the real
1-16     property described by Subsection (c) of this section.
1-17           (b)  The Texas Department of Criminal Justice shall transfer
1-18     the property by a deed without warranties.
1-19           (c)  The real property to which Subsection (a) of this
1-20     section refers is described as follows:
1-21     All that certain 36.812 acres of land, more or less, being located
1-22     and situated in the JOHN SELLERS LEAGUE, ABSTRACT 180, Galveston
1-23     County, Texas, more particularly being a part of Lots 2, 3, 4, 5
1-24     and 7 and all of Lots 6, 8, 9 and 10, Block 11, together with an
1-25     intervening 40 foot Roadway Easement, all being out of TEXAS CITY
1-26     GARDENS, a Subdivision in Galveston County, Texas, according to the
1-27     map thereof recorded in Volume 254, Page 11, Galveston County Map
1-28     Records, said 36.812 acres being more particularly described by
1-29     metes and bounds as follows:
1-30     BEGINNING at a 1-3/4 inch iron pipe found for corner and being the
1-31     Northeast corner of aforesaid Lot 2, Block 11, said point being in
1-32     the South line of Industrial Road having a 60 foot right-of-way,
1-33     and further being on the common line of the JOHN SELLERS LEAGUE
1-34     with the JOHN W. LYTTLE LEAGUE;
1-35     THENCE SOUTH, along and with the East line of said Block 11, the
1-36     same being the common line of said SELLERS and LYTTLE LEAGUES, a
1-37     distance of 1926.50 feet to a 5/8 inch iron rod found for corner
1-38     and being at the Southeast corner of aforesaid Lot 10, Block 11;
1-39     THENCE N 89 51'00" W, along and with the South line of said Lot 10,
1-40     at 545.29 feet pass the East line of a 40 foot Roadway Easement
1-41     (not open), the same being the Southwest corner of said Lot 10; at
1-42     565.29 feet pass a 5/8 inch iron rod found on line and being at the
1-43     centerline of said 40 foot Roadway Easement; at 585.29 feet pass
1-44     the Southeast corner of Lot 9, Block 11; and continuing for a total
1-45     distance of 1130.58 feet to a 5/8 inch iron rod found for corner
1-46     and being the Southwest corner of aforesaid Lot 9, the same being
1-47     the Southeast corner of Lot 10, Block 10, TEXAS CITY GARDENS;
1-48     THENCE NORTH, along and with the West line of Block 11, the same
1-49     being the East line of Block 10; at 430.86 feet pass the
1-50     Southeasterly line of a 200 foot Canal Easement to Gulf Coast Water
1-51     Authority as described in Film Code 009-19-1017, Galveston County
1-52     Deed Records; and continuing for a total distance of 745.02 feet to
1-53     a 5/8 inch iron rod found for corner, said point being at the
1-54     Northwesterly line of said 200 Canal Easement, said point being
1-55     SOUTH, a distance of 25.58 feet from the Northwest corner of Lot 7,
1-56     Block 11;
1-57     THENCE N 39 32'24" E, along and with the Northwesterly line of said
1-58     Canal Easement and across Lots 7, 5, 3, 4 and 2, a distance of
1-59     1532.56 feet to a 5/8 inch iron rod found for corner and being in
1-60     the North line of said Lot 2, the same being the South line of
1-61     aforesaid Industrial Road;
1-62     THENCE S 89 51'00" E, along and with the South line of said
1-63     Industrial Road, a distance of 154.92 feet to the POINT OF
1-64     BEGINNING and containing 36.812 acres of land, more or less.
 2-1           SECTION 2.  This Act takes effect immediately if it receives
 2-2     a vote of two-thirds of all the members elected to each house, as
 2-3     provided by Section 39, Article III, Texas Constitution.  If this
 2-4     Act does not receive the vote necessary for immediate effect, this
 2-5     Act takes effect September 1, 2001.
