 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to prohibiting the operation of a vehicle on dunes;
 1-9     providing a criminal penalty.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Chapter 750, Transportation Code, is amended by
1-12     adding Section 750.003 to read as follows:
1-13           Sec. 750.003.  OPERATION OF VEHICLE ON DUNE SEAWARD OF DUNE
1-14     PROTECTION LINE PROHIBITED.  (a)  In this section, "vehicle" means
1-15     a device that is designed to transport persons or property and is
1-16     self-propelled or propelled by external means.
1-17           (b)  A person commits an offense if the person operates a
1-18     vehicle on a sand dune seaward of the dune protection line as
1-19     defined in Section 63.012, Natural Resources Code, except on a
1-20     roadway designated by a subdivision of the state.
1-21           (c)  An offense under this section is a Class C misdemeanor.
1-22           SECTION 2.  This Act takes effect September 1, 2001.
