                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the exclusive authority of the attorney general to
 1-3     represent the state before the United States Supreme Court in all
 1-4     matters.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Section 402.021, Government Code, is amended to
 1-7     read as follows:
 1-8           Sec. 402.021.  REPRESENTATION OF STATE.  (a)  The attorney
 1-9     general shall prosecute and defend all actions in which the state
1-10     is interested before the supreme court and courts of appeal.
1-11           (b)  The attorney general shall represent the state in all
1-12     matters before the United States Supreme Court.
1-13           SECTION 2.  SEVERABILITY.  If any provision of this Act or
1-14     its application to any person or circumstance is held invalid, the
1-15     invalidity does not affect other provisions or applications of this
1-16     Act that can be given effect without the invalid provision or
1-17     application, and to this end the provisions of this Act are
1-18     declared to be severable.
1-19           SECTION 3.  EFFECTIVE DATE.  This Act takes effect on
1-20     September 1, 2001.
