No. 1203 77R3468 JMG-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to coastal area hazard reduction and recovery planning and 1-3 operations. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 418.042(a), Government Code, is amended to 1-6 read as follows: 1-7 (a) The division shall prepare and keep current a 1-8 comprehensive state emergency management plan. The plan must 1-9 include a coastal hazard reduction and recovery annex as described 1-10 by Section 418.0425 and may include: 1-11 (1) provisions for prevention and minimization of 1-12 injury and damage caused by disaster; 1-13 (2) provisions for prompt and effective response to 1-14 disaster; 1-15 (3) provisions for emergency relief; 1-16 (4) provisions for energy emergencies; 1-17 (5) identification of areas particularly vulnerable to 1-18 disasters; 1-19 (6) recommendations for zoning, building restrictions, 1-20 and other land-use controls, safety measures for securing mobile 1-21 homes or other nonpermanent or semipermanent structures, and other 1-22 preventive and preparedness measures designed to eliminate or 1-23 reduce disasters or their impact; 1-24 (7) provisions for assistance to local officials in 2-1 designing local emergency management plans; 2-2 (8) authorization and procedures for the erection or 2-3 other construction of temporary works designed to protect against 2-4 or mitigate danger, damage, or loss from flood, fire, or other 2-5 disaster; 2-6 (9) preparation and distribution to the appropriate 2-7 state and local officials of state catalogs of federal, state, and 2-8 private assistance programs; 2-9 (10) organization of manpower and channels of 2-10 assistance; 2-11 (11) coordination of federal, state, and local 2-12 emergency management activities; 2-13 (12) coordination of the state emergency management 2-14 plan with the emergency management plans of the federal government; 2-15 (13) coordination of federal and state energy 2-16 emergency plans; and 2-17 (14) other necessary matters relating to disasters. 2-18 SECTION 2. Subchapter C, Chapter 418, Government Code, is 2-19 amended by adding Section 418.0425 to read as follows: 2-20 Sec. 418.0425. COASTAL HAZARD REDUCTION AND RECOVERY ANNEX. 2-21 (a) The division shall prepare a coastal hazard reduction and 2-22 recovery annex to the state emergency management plan. The annex 2-23 must include: 2-24 (1) provisions for reduction of and recovery from 2-25 coastal hazards; 2-26 (2) provisions for providing assistance to local 2-27 coastal jurisdictions in the preparation of coastal hazard 3-1 vulnerability assessments; 3-2 (3) a process for the integration of local coastal 3-3 jurisdictions' coastal vulnerability assessments into a coastwide 3-4 vulnerability assessment; 3-5 (4) a process to network local coastal emergency 3-6 operations centers into the state operations center and provide 3-7 instant hazard analyses, evacuation route information, and support 3-8 assets of cities designated as evacuation destinations; and 3-9 (5) a procedure to conduct post-hazard analysis and 3-10 validation of vulnerability assessments. 3-11 (b) The division shall adopt rules to administer this 3-12 section. 3-13 SECTION 3. (a) This Act takes effect September 1, 2001. 3-14 (b) The division of emergency management shall implement the 3-15 Coastal Hazard Reduction and Recovery Annex as described by Section 3-16 418.0425, Government Code, as added by this Act, on or before March 3-17 1, 2002.
