No. 1207 77R6686 SGA-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to validating certain actions and the boundaries of the 1-3 Acton Municipal Utility District. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. DEFINITION. In this Act, "district" means the 1-6 Acton Municipal Utility District. 1-7 SECTION 2. VALIDATION. The following actions and annexations 1-8 of the district are validated and confirmed as if the actions and 1-9 annexations had been done as authorized by law: 1-10 (1) any resolution, order, or other act or attempted 1-11 act of the board of directors of the district relating to an 1-12 annexation by the district taken before the effective date of this 1-13 Act; and 1-14 (2) any annexation by the district since its creation. 1-15 SECTION 3. VALIDATION OF BOUNDARIES. The following 1-16 boundaries of the district are validated as the legal boundaries of 1-17 the district: 1-18 The district consists of an area in the southeast quadrant of 1-19 Hood County, including the area comprising and surrounding the 1-20 unincorporated community of Acton, as well as the subdivisions 1-21 known as Acton Meadows, the Bluffs, Bluff View on Lake Granbury, 1-22 Champion, DeCordova Bend Estates, DeCordova Hills, D. R. Bales, 1-23 Enchanted Village, Forest Oaks, Gran Tera, Grande Cove Estates, 1-24 Green Meadows, Holiday Estates, Indian Harbor, James Road, Martin, 2-1 Nassau Bay, Oak Grove Estates (formerly known as Sierra Blanca), 2-2 Part Oak, Pecan Plantation, Port Ridglea, Secluded Oaks, Stewart 2-3 Oaks, Stoney Creek, Thistle Ridge, Timber Cove, Trees, Victoria 2-4 Place, Walnut Creek, and Wild Wood Estates, and that portion of 2-5 Johnson County that includes a portion of the Pecan Plantation 2-6 subdivision. 2-7 SECTION 4. FINDINGS RELATIVE TO BOUNDARIES. The legislature 2-8 finds that the boundaries and field notes of the district form a 2-9 closure. A mistake in the field notes or in copying the field 2-10 notes in the legislative process does not affect the organization, 2-11 existence, or validity of the district, the right of the district 2-12 to levy and collect taxes, or the legality or operation of the 2-13 district or its governing body. 2-14 SECTION 5. EFFECT ON LITIGATION. This Act does not apply to 2-15 any matter that on the effective date of this Act: 2-16 (1) is involved in litigation if the litigation 2-17 ultimately results in the matter being held invalid by a final 2-18 judgment of a court; or 2-19 (2) has been held invalid by a final judgment of a 2-20 court. 2-21 SECTION 6. EFFECTIVE DATE. This Act takes effect immediately 2-22 if it receives a vote of two-thirds of all the members elected to 2-23 each house, as provided by Section 39, Article III, Texas 2-24 Constitution. If this Act does not receive the vote necessary for 2-25 immediate effect, this Act takes effect September 1, 2001.
