 1-2                                   AN ACT
 1-3     relating to the examination requirement for licensing as a chemical
 1-4     dependency counselor.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Section 504.157, Occupations Code, is amended by
 1-7     amending Subsection (c) and adding Subsection (d) to read as
 1-8     follows:
 1-9           (c)  An applicant who fails the examination may take a
1-10     subsequent examination on payment of the required examination fee.
1-11     [An applicant may not be reexamined more than three times.]
1-12           (d)  The commission by rule shall establish the criteria
1-13     under which an applicant may take a subsequent examination under
1-14     Subsection (c).
1-15           SECTION 2.  The change in law made by this Act to Subsection
1-16     (c), Section 504.157, Occupations Code, applies to a person whose
1-17     first attempt to pass an examination under Section 504.156,
1-18     Occupations Code, occurs before, on, or after the effective date of
1-19     this Act.  A person who failed an examination under Section
1-20     504.156, Occupations Code, before the effective date of this Act
1-21     may take subsequent examinations as provided by Subsection (c),
1-22     Section 504.157, Occupations Code, as amended by this Act.
1-23           SECTION 3.  This Act takes effect immediately if it receives
1-24     a vote of two-thirds of all the members elected to each house, as
1-25     provided by Section 39, Article III, Texas Constitution.  If this
 2-1     Act does not receive the vote necessary for immediate effect, this
 2-2     Act takes effect September 1, 2001.
