                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the use of a computerized voice stress analyzer by a
 1-3     licensed peace officer during a criminal investigation.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter E, Chapter 1703, Occupations Code, is
 1-6     amended by adding Section 1703.2015 to read as follows:
 1-7           Sec. 1703.2015.  VOICE STRESS ANALYZER EXEMPTION FOR PEACE
 1-8     OFFICERS. (a)  A licensed peace officer who is a certified voice
 1-9     stress examiner is not required to be licensed under this chapter
1-10     to use a computerized voice stress analyzer during a criminal
1-11     investigation.
1-12           (b)  For purposes of this section, the certification to use a
1-13     voice stress analyzer must be made by:
1-14                 (1)  the company who manufactured the voice stress
1-15     analyzer; or
1-16                 (2)  the governmental entity who appointed or employs
1-17     the peace officer.
1-18           SECTION 2.  This Act takes effect immediately if it receives
1-19     a vote of two-thirds of all the members elected to each house, as
1-20     provided by Section 39, Article III, Texas Constitution.  If this
1-21     Act does not receive the vote necessary for immediate effect, this
1-22     Act takes effect September 1, 2001.
