 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the grace period on renewal of an alcoholic beverage
 1-9     license or permit.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Section 6.04, Alcoholic Beverage Code, is amended
1-12     to read as follows:
1-13           Sec. 6.04.  GRACE PERIOD ON RENEWAL OF LICENSES AND PERMITS.
1-14     (a)  Notwithstanding any other provision of this code, the holder
1-15     of a license or permit issued under this code may renew the license
1-16     or permit rather than reapply for an original license or permit if,
1-17     not later than the 30th [10th] day after the date of the expiration
1-18     of the license or permit, the holder files a renewal application
1-19     and the required license or permit fee with the commission and pays
1-20     a late [renewal] fee as provided by rules of the commission [of
1-21     $100 and the license or permit fee that is due].
1-22           (b)  If an application is filed under Subsection (a) [of this
1-23     section], a violation of the law that occurs before the filing of a
1-24     renewal application may be the basis for an administrative action
1-25     against the holder of the license or permit.
1-26           (c)  The holder of a license or permit who does not renew the
1-27     license or permit before its expiration date may not operate until
1-28     the holder files an application under Subsection (a).
1-29           (d)  The commission shall adopt rules necessary to implement
1-30     this section.
1-31           SECTION 2.  This Act takes effect September 1, 2001.
