                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to criminal penalties for arson resulting in the death of
 1-3     a fire fighter.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 28.02(d), Penal Code, is amended to read
 1-6     as follows:
 1-7           (d)  An offense under this section is a felony of the second
 1-8     degree, except that:
 1-9                 (1)  the offense is a felony of the first degree if it
1-10     is shown on the trial of the offense that:
1-11                       (A) [(1)]  bodily injury or death was suffered by
1-12     any person by reason of the commission of the offense; or
1-13                       (B) [(2)]  the actor committed the offense
1-14     knowing that the property intended to be damaged or destroyed was a
1-15     place of worship; and
1-16                 (2)  the offense is a capital felony if it is shown on
1-17     the trial of the offense that death was suffered by a fire fighter
1-18     by reason of the commission of the offense.
1-19           SECTION 2.  The effect date of this act is September 1, 2001.
