A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to placement of vehicle registration and inspection
1-3 stickers.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 502.180(d), Transportation Code, is
1-6 amended to read as follows:
1-7 (d) Except as provided by Subsection (h), the registration
1-8 insignia for validation of a license plate shall be attached to the
1-9 inside of the vehicle's windshield or rear window[, if the vehicle
1-10 has a windshield,] within six inches of the place where the motor
1-11 vehicle inspection sticker is [required to be] placed. If the
1-12 vehicle does not have a windshield or rear window, the owner, when
1-13 applying for registration or renewal of registration, shall notify
1-14 the department, and the department shall issue a distinctive device
1-15 for attachment to the rear license plate of the vehicle.
1-16 SECTION 2. Section 548.255(a), Transportation Code, is
1-17 amended to read as follows:
1-18 (a) An inspection certificate shall be attached to the
1-19 windshield or rear window of [or produced for] a vehicle, at the
1-20 option of the vehicle's owner, in the manner required by department
1-21 rule. An inspection certificate shall be produced for a vehicle in
1-22 the manner required by department rule.
1-23 SECTION 3. Section 548.053(c), Transportation Code, is
1-24 amended to read as follows:
2-1 (c) If a vehicle subject to this chapter is damaged to the
2-2 apparent extent that it would require repair before passing
2-3 inspection, the investigating officer shall remove the inspection
2-4 certificate from the vehicle [windshield] and give the operator of
2-5 the vehicle a dated receipt. The vehicle must be reinspected not
2-6 later than the 30th day after the date shown on the receipt.
2-7 SECTION 4. Section 548.602(b), Transportation Code, is
2-8 amended to read as follows:
2-9 (b) A peace officer who exhibits a badge or other sign of
2-10 authority may stop a vehicle not displaying an inspection
2-11 certificate on the vehicle [windshield] and require the owner or
2-12 operator to produce an inspection certificate for the vehicle.
2-13 SECTION 5. Section 623.011(d), Transportation Code, is
2-14 amended to read as follows:
2-15 (d) When the department issues a permit under this section,
2-16 the department shall issue a sticker to be placed on the [front
2-17 windshield of the] vehicle above the inspection certificate issued
2-18 to the vehicle. The department shall design the form of the
2-19 sticker to aid in the enforcement of weight limits for vehicles.
2-20 SECTION 6. Section 683.051, Transportation Code, is amended
2-21 to read as follows:
2-22 Sec. 683.051. APPLICATION FOR AUTHORIZATION TO DISPOSE OF
2-23 CERTAIN MOTOR VEHICLES. A person may apply to the department for
2-24 authority:
2-25 (1) to sell, give away, or dispose of a motor vehicle
2-26 to a motor vehicle demolisher if:
2-27 (A) the person owns the motor vehicle and the
3-1 certificate of title to the vehicle is lost, destroyed, or faulty;
3-2 or
3-3 (B) the vehicle is an abandoned motor vehicle
3-4 and is:
3-5 (i) in the possession of the person; or
3-6 (ii) located on property owned by the
3-7 person; or
3-8 (2) to dispose of a motor vehicle to a motor vehicle
3-9 demolisher for demolition, wrecking, or dismantling if:
3-10 (A) the abandoned motor vehicle:
3-11 (i) is in the possession of the person;
3-12 (ii) is more than eight years old;
3-13 (iii) either has no motor or is otherwise
3-14 totally inoperable or does not comply with all applicable air
3-15 pollution emissions control related requirements included in:
3-16 (a) [(aa)] the vehicle inspection
3-17 requirements under Chapter 548, as evidenced by a current
3-18 inspection certificate affixed to the vehicle [windshield]; or
3-19 (b) [(bb)] the vehicle emissions
3-20 inspection and maintenance requirements contained in the Public
3-21 Safety Commission's motor vehicle emissions inspection and
3-22 maintenance program under Subchapter F, Chapter 548, or the state's
3-23 air quality state implementation plan; and
3-24 (iv) was authorized to be towed by a law
3-25 enforcement agency; and
3-26 (B) the law enforcement agency approves the
3-27 application.
4-1 SECTION 7. This Act takes effect January 1, 2002.
4-2 SECTION 8. Before September 1, 2001, the Department of
4-3 Public Safety shall adopt rules providing for the manner of
4-4 attachment of an inspection certificate to the windshield or rear
4-5 window of a vehicle.
