1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to placement of vehicle registration and inspection
1-9 stickers.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Subsection (d), Section 502.180, Transportation
1-12 Code, is amended to read as follows:
1-13 (d) Except as provided by Subsection (h), the registration
1-14 insignia for validation of a license plate shall be attached to the
1-15 inside of the vehicle's windshield or rear window[, if the vehicle
1-16 has a windshield,] within six inches of the place where the motor
1-17 vehicle inspection sticker is [required to be] placed. If the
1-18 vehicle does not have a windshield or rear window, the owner, when
1-19 applying for registration or renewal of registration, shall notify
1-20 the department, and the department shall issue a distinctive device
1-21 for attachment to the rear license plate of the vehicle.
1-22 SECTION 2. Subsection (a), Section 548.255, Transportation
1-23 Code, is amended to read as follows:
1-24 (a) An inspection certificate shall be attached to the
1-25 windshield or rear window of [or produced for] a vehicle, at the
1-26 option of the vehicle's owner, in the manner required by department
1-27 rule. An inspection certificate shall be produced for a vehicle in
1-28 the manner required by department rule.
1-29 SECTION 3. Subsection (c), Section 548.053, Transportation
1-30 Code, is amended to read as follows:
1-31 (c) If a vehicle subject to this chapter is damaged to the
1-32 apparent extent that it would require repair before passing
1-33 inspection, the investigating officer shall remove the inspection
1-34 certificate from the vehicle [windshield] and give the operator of
1-35 the vehicle a dated receipt. The vehicle must be reinspected not
1-36 later than the 30th day after the date shown on the receipt.
1-37 SECTION 4. Subsection (b), Section 548.602, Transportation
1-38 Code, is amended to read as follows:
1-39 (b) A peace officer who exhibits a badge or other sign of
1-40 authority may stop a vehicle not displaying an inspection
1-41 certificate on the vehicle [windshield] and require the owner or
1-42 operator to produce an inspection certificate for the vehicle.
1-43 SECTION 5. Subsection (d), Section 623.011, Transportation
1-44 Code, is amended to read as follows:
1-45 (d) When the department issues a permit under this section,
1-46 the department shall issue a sticker to be placed on the [front
1-47 windshield of the] vehicle above the inspection certificate issued
1-48 to the vehicle. The department shall design the form of the
1-49 sticker to aid in the enforcement of weight limits for vehicles.
1-50 SECTION 6. Section 683.051, Transportation Code, is amended
1-51 to read as follows:
1-52 Sec. 683.051. APPLICATION FOR AUTHORIZATION TO DISPOSE OF
1-53 CERTAIN MOTOR VEHICLES. A person may apply to the department for
1-54 authority:
1-55 (1) to sell, give away, or dispose of a motor vehicle
1-56 to a motor vehicle demolisher if:
1-57 (A) the person owns the motor vehicle and the
1-58 certificate of title to the vehicle is lost, destroyed, or faulty;
1-59 or
1-60 (B) the vehicle is an abandoned motor vehicle
1-61 and is:
1-62 (i) in the possession of the person; or
1-63 (ii) located on property owned by the
1-64 person; or
2-1 (2) to dispose of a motor vehicle to a motor vehicle
2-2 demolisher for demolition, wrecking, or dismantling if:
2-3 (A) the abandoned motor vehicle:
2-4 (i) is in the possession of the person;
2-5 (ii) is more than eight years old;
2-6 (iii) either has no motor or is otherwise
2-7 totally inoperable or does not comply with all applicable air
2-8 pollution emissions control related requirements included in:
2-9 (a) [(aa)] the vehicle inspection
2-10 requirements under Chapter 548, as evidenced by a current
2-11 inspection certificate affixed to the vehicle [windshield]; or
2-12 (b) [(bb)] the vehicle emissions
2-13 inspection and maintenance requirements contained in the Public
2-14 Safety Commission's motor vehicle emissions inspection and
2-15 maintenance program under Subchapter F, Chapter 548, or the state's
2-16 air quality state implementation plan; and
2-17 (iv) was authorized to be towed by a law
2-18 enforcement agency; and
2-19 (B) the law enforcement agency approves the
2-20 application.
2-21 SECTION 7. This Act takes effect January 1, 2002.
2-22 SECTION 8. Before September 1, 2001, the Department of
2-23 Public Safety of the State of Texas shall adopt rules providing for
2-24 the manner of attachment of an inspection certificate to the
2-25 windshield or rear window of a vehicle.
