 1-9                                   AN ACT
1-10     relating to designating a model injury prevention center.
1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12           SECTION 1.  Subtitle B, Title 9, Health and Safety Code, is
1-13     amended by adding Chapter 780 to read as follows:
1-14                CHAPTER 780.  MODEL INJURY PREVENTION CENTER
1-15           Sec. 780.001.  DEFINITIONS.  In this chapter:
1-16                 (1)  "Board" means the Texas Board of Health.
1-17                 (2)  "Department" means the Texas Department of Health.
1-18           Sec. 780.002.  INJURY PREVENTION CENTER.  (a)  The department
1-19     shall designate a model center for injury prevention for the state.
1-20           (b)  To be eligible for designation as the model center, an
1-21     injury prevention center must have been in existence for at least
1-22     five years and must have the capacity to:
1-23                 (1)  acquire additional resources valued at $500,000 or
1-24     more;
1-25                 (2)  lead community interventions;
1-26                 (3)  do research; and
1-27                 (4)  collect information and usefully link the
1-28     collected information together.
1-29           (c)  The department's designation of an injury prevention
1-30     center as the model injury prevention center is for a five-year
1-31     period.
1-32           (d)  The model injury prevention center shall coordinate
1-33     injury prevention control activities for the state in the manner
1-34     that the department prescribes by rule.  The department may adopt
1-35     rules permitting the model injury prevention center to provide
1-36     services for regions served by other injury prevention centers in
1-37     this state as necessary to maximize efficient use of resources and
1-38     provide appropriate services.
1-39           (e)  The model injury prevention center shall affiliate with
1-40     a level one, two, or three trauma center as defined by the American
1-41     College of Surgeons.
1-42           Sec. 780.003.  COMMUNITY PROGRAMS AND ASSISTANCE.  The model
1-43     injury prevention center shall:
1-44                 (1)  work with communities and neighborhoods to help
1-45     establish their injury prevention priorities;
1-46                 (2)  help communities define and implement
1-47     interventions and maintain a best practices website for review and
1-48     use by communities and institutions;
1-49                 (3)  develop links between electronic databases to
1-50     provide data to community entities;
1-51                 (4)  provide leadership by bringing community entities
1-52     together to address injury issues; and
1-53                 (5)  undertake a continuing epidemiologic evaluation of
1-54     the effectiveness of community-based interventions in reducing the
1-55     number and extent of injuries and in reducing costs.
1-56           Sec. 780.004.  RESOURCE CENTER.  (a)  The model injury
1-57     prevention center shall serve as the statewide resource center to
1-58     provide:
1-59                 (1)  assistance on how to develop and implement an
1-60     injury prevention program;
1-61                 (2)  assistance on how to develop effective coalitions;
1-62                 (3)  public awareness campaigns on injury reductions;
1-63     and
1-64                 (4)  technical assistance on how to develop and
 2-1     implement an evaluation process to determine the effectiveness of
 2-2     injury prevention interventions.
 2-3           (b)  The model injury prevention center shall develop and
 2-4     publish a statewide strategic plan regarding the center's
 2-5     activities under this chapter and regarding ways to improve injury
 2-6     prevention efforts in this state.
 2-7           Sec. 780.005.  RESEARCH PROGRAMS.  (a)  The model injury
 2-8     prevention center may conduct a research program to improve
 2-9     treatments for trauma victims and to reduce the severity of
2-10     injuries from trauma.
2-11           (b)  The model injury prevention center may accept gifts or
2-12     grants from public or private sources to be used for research.
2-13           Sec. 780.006.  STATE LIABILITY.  The model injury prevention
2-14     center is considered a state agency only for purposes of Chapter
2-15     104, Civil Practice and Remedies Code.  An employee or a former
2-16     employee of the center during the time that the center is
2-17     designated as the model injury prevention center is considered a
2-18     state employee or a former state employee only for purposes of
2-19     Chapter 104, Civil Practice and Remedies Code.
2-20           Sec. 780.007.  GIFTS AND GRANTS.  (a)  The department may
2-21     approve grants to the model injury prevention center according to
2-22     adopted rules.  A grant awarded under this section is governed by
2-23     Chapter 783, Government Code, and the rules adopted under that
2-24     chapter.
2-25           (b)  The department may accept gifts or grants from any
2-26     source for purposes related to this chapter.
2-27           SECTION 2.  This Act takes effect immediately if it receives
2-28     a vote of two-thirds of all the members elected to each house, as
2-29     provided by Section 39, Article III, Texas Constitution.  If this
2-30     Act does not receive the vote necessary for immediate effect, this
2-31     Act takes effect September 1, 2001.
