                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the punishment of the offense of indecent exposure.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 21.08, Penal Code, is amended by amending
 1-5     Subsection (b) and by adding Subsection (c) to read as follows:
 1-6           (b)  Except as provided by Subsection (c), a first [An]
 1-7     offense under this section is a Class B misdemeanor.
 1-8           (c)  A second offense under this section is a Class A
 1-9     misdemeanor.
1-10           (d)  An offense under this section is a state jail felony if
1-11     it is shown on the trial of the offense that the defendant has
1-12     previously been convicted at least:
1-13                 (1)  two times under this section;
1-14                 (2)  two times under Section 21.11; or
1-15                 (3)  one time under this section and one time under
1-16     Section 21.11.
1-17           SECTION 2.  (a)  The change in law made by this Act applies
1-18     only to the punishment for an offense committed on or after the
1-19     effective date of this Act.  For purposes of this section, an
1-20     offense is committed before the effective date of this Act if any
1-21     element of the offense occurs before the effective date.
1-22           (b)  An offense committed before the effective date of this
1-23     Act is covered by the law in effect when the offense was committed,
 2-1     and the former law is continued in effect for that purpose.
 2-2           SECTION 3.  This Act takes effect September 1, 2001.
