                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to incorporating services for children with special health
 1-3     care needs into the state child health plan for certain low-income
 1-4     children.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Subchapter D, Chapter 62, Health and Safety Code,
 1-7     is amended by adding Section 62.1515 to read as follows:
 1-8           Sec. 62.1515.  WRAP-AROUND SERVICES FOR CHILDREN WITH SPECIAL
 1-9     HEALTH CARE NEEDS.  (a)  In this section, "eligible special health
1-10     care needs child" means a child with special health care needs as
1-11     described by Section 35.0022 who meets the eligibility requirements
1-12     of this chapter and Section 35.005.
1-13           (b)  The commission, in consultation with the Texas
1-14     Department of Health, shall determine which services described by
1-15     Section 35.003(a) are provided to an eligible special health care
1-16     needs child as covered benefits under the child health plan and
1-17     which services are provided under Chapter 35.
1-18           (c)  In making the determination under Subsection (b), the
1-19     commission and the Texas Department of Health shall seek to obtain
1-20     the maximum amount of federal matching money for the child health
1-21     plan and for the services program for children with special health
1-22     care needs under Chapter 35.
1-23           SECTION 2.  This Act takes effect immediately if it receives
1-24     a vote of two-thirds of all the members elected to each house, as
 2-1     provided by Section 39, Article III, Texas Constitution.  If this
 2-2     Act does not receive the vote necessary for immediate effect, this
 2-3     Act takes effect September 1, 2001.
