                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to a county's authority to set a fee for certain permits.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1. Subchapter A, Chapter 251, Transportation Code, is
 1-5     amended by adding Section 251.017 to read as follows:
 1-6           Sec. 251.017.  COUNTY AUTHORITY TO SET FEE.  The
 1-7     commissioners court of a county may set a reasonable fee for the
 1-8     county's issuance of a permit authorized by this chapter for which
 1-9     a fee is not specifically prescribed.  The fee must be set and
1-10     itemized in the county's budget as part of the budget preparation
1-11     process.
1-12           SECTION 2. Subchapter I, Chapter 16, Water Code, is amended
1-13     by adding Section 16.324 to read as follows:
1-14           Sec. 16.324.  COUNTY AUTHORITY TO SET FEE.  The commissioners
1-15     court of a county may set a reasonable fee for the county's
1-16     issuance of a permit authorized by this subchapter for which a fee
1-17     is not specifically prescribed.  The fee must be set and itemized
1-18     in the county's budget as part of the budget preparation process.
1-19           SECTION 3. This Act takes effect September 1, 2001.
