 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to a county's authority to set a fee or other charge for
1-11     certain licenses, permits, registrations, or other administrative
1-12     expenses.
1-13           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-14           SECTION 1.  Subsection (b), Article 42.033, Code of Criminal
1-15     Procedure, is amended to read as follows:
1-16           (b)  The court may impose as a condition to permitting a
1-17     defendant to serve the jail time assessed or period of confinement
1-18     intermittently an additional requirement that the defendant make
1-19     any of the following payments to the court, agencies, or persons,
1-20     or that the defendant execute a letter and direct it to the
1-21     defendant's employer directing the employer to deduct from the
1-22     defendant's salary an amount directed by the court, which is to be
1-23     sent by the employer to the clerk of the court.  The money received
1-24     by the court under this section may be used to pay the following
1-25     expenses as directed by the court:
1-26                 (1)  the support of the defendant's dependents, if
1-27     necessary;
1-28                 (2)  the defendant's documented personal, business, and
1-29     travel expenses;
1-30                 (3)  reimbursement of the general fund of the county,
1-31     in an amount determined by the commissioners court, for the
1-32     maintenance of the defendant in jail; and
1-33                 (4)  installment payments on restitution, fines, and
1-34     court costs ordered by the court.
1-35           SECTION 2.  Subchapter A, Chapter 251, Transportation Code,
1-36     is amended by adding Section 251.017 to read as follows:
1-37           Sec. 251.017.  COUNTY AUTHORITY TO SET FEE.  The
1-38     commissioners court of a county may set a reasonable fee for the
1-39     county's issuance of a license, permit, or registration authorized
1-40     by this chapter for which a fee is not specifically prescribed.
1-41           SECTION 3.  Subchapter I, Chapter 16, Water Code, is amended
1-42     by adding Section 16.324 to read as follows:
1-43           Sec. 16.324.  COUNTY AUTHORITY TO SET FEES.  The
1-44     commissioners court of a county may set reasonable and necessary
1-45     fees to administer this subchapter.
1-46           SECTION 4.  This Act takes effect September 1, 2001.
