No. 1309 1-2 (In the Senate - Filed March 8, 2001; March 12, 2001, read 1-3 first time and referred to Committee on State Affairs; 1-4 April 11, 2001, reported favorably by the following vote: Yeas 6, 1-5 Nays 1; April 11, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to a challenge of voter registration. 1-9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-10 SECTION 1. Section 16.092, Election Code, is amended to read 1-11 as follows: 1-12 Sec. 16.092. SWORN STATEMENT REQUIRED. (a) A voter 1-13 desiring to challenge a registration must file with the registrar a 1-14 sworn statement of the grounds for the challenge. 1-15 (b) The voter filing the sworn statement must properly 1-16 identify each challenged voter in the sworn statement. 1-17 (c) The voter filing the sworn statement must state a 1-18 challenge, based upon personal knowledge, that each challenged 1-19 voter does not possess a specific qualification for remaining 1-20 registered. 1-21 SECTION 2. This Act takes effect immediately if it receives 1-22 a vote of two-thirds of all members elected to each house, as 1-23 provided by Section 39, Article III, Texas Constitution. If this 1-24 Act does not receive the vote necessary for immediate effect, this 1-25 Act takes effect September 1, 2001. 1-26 * * * * *
