No. 1311 By: Gallegos 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to the challenge of a voter registration. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Section 16.0921, Election Code, is amended by 1-13 amending Subsection (a) and adding Subsection (c) to read as 1-14 follows: 1-15 (a) On the filing of a sworn statement under Section 16.092 1-16 alleging a ground based on residence, the registrar shall promptly 1-17 deliver to the voter whose registration is challenged a 1-18 confirmation notice in accordance with Section 15.051, subject to 1-19 Subsection (c). 1-20 (c) A voter's registration as to a particular election may 1-21 not be challenged on the basis of residence after the 75th day 1-22 before election day. The registrar may not deliver a confirmation 1-23 notice to such a voter until after election day. 1-24 SECTION 2. This Act takes effect immediately if it receives 1-25 a vote of two-thirds of all members elected to each house, as 1-26 provided by Section 39, Article III, Texas Constitution. If this 1-27 Act does not receive the vote necessary for immediate effect, this 1-28 Act takes effect September 1, 2001. 1-29 * * * * *
