                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to clean up legislation concerning sex offenders.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4     SECTION 1.  Section 521.222, Transportation Code is amended by
 1-5     adding the following:
 1-6     Section 521.222, Instruction Permit
 1-7     (f)  The Department may issue a learner's license under this
 1-8     section to an applicant who is subject to registration requirements
 1-9     under Chapter 62, Code of Criminal Procedure.  The learner's
1-10     license will include a photo image.  It is subject to all
1-11     requirements and restrictions of an instruction permit.  The fee
1-12     for a learner's license issued under this subsection is $20.
1-13     SECTION 2.  Section 521.223, Transportation Code is amended by
1-14     adding the following:
1-15     Section 521.223 (g), Hardship License
1-16     (g)  An applicant who meets the requirements of subsection (a) or
1-17     (d) who is subject to the registration requirements of Chapter 62,
1-18     Code of Criminal Procedure, will be provided a photo license.  A
1-19     license issued under this subsection is subject to all requirements
1-20     and restrictions imposed by this section.  The fee for a license
1-21     issued under this subsection is $20
1-22     SECTION 3.  Section 521.272, Transportation Code, is amended by
1-23     adding the following:
 2-1     Section 521.272 (d), Renewal of License Issued to certain Sex
 2-2     Offenders
 2-3     (d)  Provisions of subsection (c) do not apply to applicants under
 2-4     the age of 18.  A learner's license, hardship license or
 2-5     provisional license expires according to provisions of sections
 2-6     521.222, 521.223, and 521.271.
 2-7     SECTION 4.  Section 521.274, Transportation Code, is amended to
 2-8     read as follows:
 2-9     Section 521.274, Renewal by Mail or Electronic Means
2-10     The department by rule may provide that the holder of a driver's
2-11     license may renew the license by mail, by telephone, over the
2-12     Internet, or by other electronic means.  A rule adopted under this
2-13     section may prescribe eligibility standards for renewal under this
2-14     section.  A rule adopted under this section may not permit renewal
2-15     by mail or electronic means if the record indicates that the holder
2-16     is subject to the registration requirements of Chapter 62, Code of
2-17     Criminal Procedure.
2-18     Repeal the following as added by L.1999, chap. 1401(8), eff.
2-19     9/1/2000 [Section 521.274.  Renewal by Mail]
2-20     [(a)  The department by rule may provide that the holder of a
2-21     driver's license may renew the license by mail.]
2-22     [(b)  A rule adopted under this subsection may not permit renewal by
2-23     mail of:]
2-24     [(1)  a provisional license;]
2-25     [(2)  an occupational license; or]
2-26     [(3)  a driver's license if the license holder's:]
 3-1     [(A)  driving record as maintained by the department shows that the
 3-2     holder, within the four years preceding the date of the renewal
 3-3     application, has been convicted of:]
 3-4     [(i)  a moving violation, as defined by department rule, in this
 3-5     state; or]
 3-6     [(ii)  an offense described by Subchapter O;  or]
 3-7     [(B)  driver's license record or personal identification certificate
 3-8     record indicates that the holder is subject to the registration
 3-9     requirements of Chapter 62, Code of Criminal Procedure, as added by
3-10     Chapter 668, Acts of the 75th Legislature, Regular Session, 1997.]
3-11     SECTION 5.  Section 521.421, Transportation Code, is amended to
3-12     read as follows:
3-13     Section 521.421 (h), License fees, examination fees.
3-14     (h)  The fee for a license issued under Section 521.272 or to an
3-15     applicant who is subject to registration requirements of Chapter
3-16     62, Code of Criminal Procedure is $20.
3-17     SECTION 6.  Section 521.422, Transportation Code, is amended to
3-18     read as follows:
3-19     Section 521.422 (a) (3), Personal identification certificate fee.
3-20     (a)  The fee for a personal identification certificate is:
3-21     (1)  $15 for a person under 60 years of age; [and]
3-22     (2)  $5 for a person 60 years of age or older; and
3-23     (3)  $20 for a person issued a personal identification certificate
3-24     under section 521.103.
3-25     SECTION 7.  Section 521.426, Transportation Code, is amended to
3-26     read as follows:
 4-1     Section 521.426 (c), Disabled veteran exemption.
 4-2     (c)  This section does not apply to a person who is required to
 4-3     obtain or renew their driver license under section 521.272.
 4-4     SECTION 8.  Section 522.029, Transportation Code, is amended to
 4-5     read as follows:
 4-6     Section 522.029, Fees.
 4-7     (a)  The fee for a commercial driver's license or commercial
 4-8     driver's learner's permit issued by the department is $60, except
 4-9     as provided by Subsection (f) and Subsection (h).
4-10     (h)  The fee for a commercial driver's license or commercial
4-11     driver's learner's permit issued in compliance with Section 521.272
4-12     is $20.
4-13     SECTION 9.  Section 522.033, Transportation Code, is created to
4-14     read as follows:
4-15     Section 522.033, Commercial Driver License Issued to Certain Sex
4-16     Offenders
4-17     The Department may issue an original or renewal commercial driver
4-18     license to a person who is subject to registration requirements of
4-19     Chapter 62, Code of Criminal Procedure, only if the person applies
4-20     in accordance with Section 521.272.
4-21     SECTION 10.  Section 522.051, Transportation Code, is amended to
4-22     read as follows:
4-23     Section 522.051 (f), Expiration of license or permit.
4-24     (f)  The expiration of a commercial driver's license or commercial
4-25     driver's learner's permit issued in compliance with Section 521.272
4-26     expires on the first birthday of the license holder occurring after
 5-1     the date of application, except that the initial license issued
 5-2     under Section 521.272 expires on the second birthday of the license
 5-3     holder occurring after the date of application.
 5-4     SECTION 11.  Section 522.052, Transportation Code, is amended to
 5-5     read as follows:
 5-6     Section 522.052 (a), Renewal of License
 5-7     (a)  A commercial driver's license issued by the department may be
 5-8     renewed in the year preceding the expiration date except those
 5-9     licenses issued under the provisions of Section 521.272 which can
5-10     only be renewed 60 days preceding the expiration date.
5-11     SECTION 12.  This Act takes effect September 1, 2001.
