 1-9                            A BILL TO BE ENTITLED
1-10                                   AN ACT
1-11     relating to reporting requirements regarding certain
1-12     clothes-washing machines.
1-13           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-14           SECTION 1.  Chapter 372, Health and Safety Code, is amended
1-15     by adding Section 372.004 to read as follows:
1-16           Sec. 372.004.  REPORT TO LEGISLATURE.  (a)  In this section,
1-17     "water consumption factor" has the meaning assigned by 10 C.F.R.
1-18     Part 430, Subpart B, Appendix J, as that appendix existed on
1-19     September 1, 2001.
1-20           (b)  This section does not apply to a clothes-washing machine
1-21     with a capacity of more than 3.5 cubic feet or less than 1.6 cubic
1-22     feet.
1-23           (c)  Beginning in February 2003 the commission shall report
1-24     to the legislature in February of each year on:
1-25                 (1)  the number of clothes-washing machines with a
1-26     water consumption factor of more than 11 that were imported into
1-27     this state during the preceding calendar year;
1-28                 (2)  the number of clothes-washing machines with a
1-29     water consumption factor of more than 9.5 but not more than 11 that
1-30     were imported into this state during the preceding calendar year;
1-31                 (3)  the number of clothes-washing machines with a
1-32     water consumption factor of 9.5 or less that were imported into
1-33     this state during the preceding calendar year; and
1-34                 (4)  the average water consumption factor of all
1-35     clothes-washing machines that were imported into this state during
1-36     the preceding calendar year.
1-37           (d)  The commission by rule shall require appropriate
1-38     industry trade associations or other entities to provide the
1-39     information described by Subsection (c) to the commission by
1-40     January 2003 and each January thereafter.
1-41           SECTION 2.  This Act takes effect September 1, 2001.
