No. 1340 77R4531 MXM-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the creation of a division to study transferring to 1-3 private contractors certain state agency personal computing 1-4 equipment and the responsibility for computer services. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Chapter 2054, Government Code, is amended by 1-7 adding Subchapter I to read as follows: 1-8 SUBCHAPTER I. SEAT MANAGEMENT DIVISION 1-9 Sec. 2054.251. DEFINITIONS. In this subchapter: 1-10 (1) "Division" means the seat management division 1-11 created under this subchapter. 1-12 (2) "Seat management" means the seat management method 1-13 described by Section 2054.254(b). 1-14 Sec. 2054.252. CREATION. The department shall create a seat 1-15 management division to: 1-16 (1) conduct the study under Section 2054.253; and 1-17 (2) make recommendations under Section 2054.254. 1-18 Sec. 2054.253. TOTAL COST OF OWNERSHIP STUDIES. (a) The 1-19 department shall select 10 to 12 state agencies to participate in a 1-20 pilot study. Each agency shall study the total cost of all 1-21 personal computers and related systems used by the agency, 1-22 including both owned and leased systems. The study must include: 1-23 (1) direct costs, including costs for hardware, 1-24 software, peripheral equipment, networks, management and support 2-1 labor hours, systems development, and communications; and 2-2 (2) indirect costs, including computer downtime and 2-3 end-user training, self-teaching, support, and any other costs 2-4 related to the use of the personal computer. 2-5 (b) The department, including the division, on request shall 2-6 assist an agency in complying with this section. 2-7 (c) Not later than May 1, 2002, each agency shall report on 2-8 the results of its study to the department, including the division. 2-9 Sec. 2054.254. STUDY AND RECOMMENDATIONS ON USE OF PRIVATE 2-10 CONTRACTORS TO IMPLEMENT SEAT MANAGEMENT. (a) The division shall 2-11 analyze the results of the studies under Section 2054.253 to assess 2-12 the feasibility of establishing a statewide seat management system 2-13 at the time the assessment is completed or at a later time. 2-14 (b) As part of this feasibility study, the division shall 2-15 analyze seat management, through which a state agency transfers its 2-16 personal computer equipment and services responsibilities to a 2-17 private vendor as described by this subsection. The agency would 2-18 hire a single private vendor to manage the personal computing needs 2-19 for each desktop in a state agency, including all necessary 2-20 hardware, software, and support services. Under this method, the 2-21 vendor would be responsible for some or all planning, installation, 2-22 configuration, testing, maintenance, repair, upgrading, training, 2-23 project management, asset management, disposal, and other services 2-24 related to the agency's personal computing needs. Subject to the 2-25 agency's needs and a vendor contract, a vendor selected by the 2-26 agency would satisfy the agency's personal computer needs, 2-27 including: 3-1 (1) personal computer acquisition and support; 3-2 (2) local area networks; 3-3 (3) Internet access; 3-4 (4) electronic mail; 3-5 (5) help desk support for user questions and 3-6 maintenance requests; 3-7 (6) remote access needs; 3-8 (7) technology upgrades necessary to keep equipment 3-9 current; and 3-10 (8) any other data, voice, and video communication 3-11 needs. 3-12 (c) The division shall study different types of contracts 3-13 that could be used to implement seat management. 3-14 (d) Not later than November 1, 2002, the division shall 3-15 report its recommendations to the presiding officer of each house 3-16 of the legislature and to the committees of each house of the 3-17 legislature that have primary oversight jurisdiction over the 3-18 department. The recommendations must include: 3-19 (1) an appropriate plan to transfer each state 3-20 agency's computer equipment and service responsibilities to private 3-21 contractors; 3-22 (2) an estimate of implementation costs; 3-23 (3) an estimate of potential savings due to the 3-24 transfer; and 3-25 (4) a plan for developing seat management contracts, 3-26 including the development of a multiple award schedule of 3-27 contracts. 4-1 Sec. 2054.255. PERSONAL COMPUTER INVENTORY REPORTING BY 4-2 STATE AGENCIES. Not later than September 1, 2002, and September 1, 4-3 2003, each state agency shall provide the division with an 4-4 inventory of all personal computers used by that agency as of June 4-5 1, 2002, and June 1, 2003, respectively. 4-6 Sec. 2054.256. EXPIRATION. This subchapter expires 4-7 September 2, 2003. 4-8 SECTION 2. This Act takes effect immediately if it receives 4-9 a vote of two-thirds of all the members elected to each house, as 4-10 provided by Section 39, Article III, Texas Constitution. If this 4-11 Act does not receive the vote necessary for immediate effect, this 4-12 Act takes effect September 1, 2001.
