No. 1348 as follows: 1-8 (1) In SECTION 1 of the bill, in Subsection (a), Section 1-9 314.005, Government Code (Introduced version page 1, line 28), 1-10 strike "board" and substitute "state auditor". 1-11 (2) In SECTION 1 of the bill, strike Subsection (c), Section 1-12 314.005, Government Code (Introduced version page 1, lines 38 1-13 through 46), and substitute the following: 1-14 (c) The state auditor shall deliver a copy of the impact 1-15 statement to the author of the bill or resolution and to each 1-16 member of a legislative committee to which the bill or resolution 1-17 is referred not later than the fifth day after the date the bill or 1-18 resolution is referred to the committee. 1-19 A BILL TO BE ENTITLED 1-20 AN ACT 1-21 relating to requiring a court cost impact statement on a bill or 1-22 resolution that imposes a court cost on a person charged with a 1-23 criminal offense. 1-24 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-25 SECTION 1. Chapter 314, Government Code, is amended by 1-26 adding Section 314.005 to read as follows: 1-27 Sec. 314.005. IMPOSING COURT COSTS ON CERTAIN CRIMINAL 1-28 DEFENDANTS. (a) The board shall prepare an impact statement for 1-29 each bill or resolution proposing a constitutional amendment that 1-30 proposes a new court cost or fee or an increase in the amount of a 1-31 court cost or fee on a person charged with a criminal offense, 1-32 including a court cost or fee charged on conviction or other 1-33 disposition or postponed disposition of the criminal charge. 1-34 (b) The impact statement must show the total amount of court 1-35 costs and fees that persons will be required to pay under the bill 1-36 or resolution when considered together with all other applicable 1-37 laws. 1-38 (c) The board shall deliver a copy of the impact statement 1-39 to the author of the bill or resolution and to each member of a 1-40 legislative committee to which the bill or resolution is referred 1-41 not later than the 10th day after the date the bill or resolution 1-42 is referred to the committee. If required or permitted by the 1-43 rules of the applicable house of the legislature, the impact 1-44 statement must be attached to the bill or resolution in the same 1-45 manner that a fiscal note must be attached under Section 314.003 1-46 and applicable legislative rules. 1-47 SECTION 2.
