 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the size of certain piers in coastal public lands.
 1-9           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-10           SECTION 1.  Subsection (a), Section 33.115, Natural Resources
1-11     Code, is amended to read as follows:
1-12           (a)  Without obtaining an easement from the board, the owner
1-13     of littoral property may construct a pier which:
1-14                 (1)  may be used for any purpose except commercial
1-15     purposes;
1-16                 (2)  is 115 [100] feet or less in length and 25 feet or
1-17     less in width; and
1-18                 (3)  requires no filling or dredging.
1-19           SECTION 2.  The change in law made by this Act applies to any
1-20     pier constructed by an owner of littoral property, including a pier
1-21     constructed before the effective date of this Act.
1-22           SECTION 3.  This Act takes effect immediately if it receives
1-23     a vote of two-thirds of all the members elected to each house, as
1-24     provided by Section 39, Article III, Texas Constitution.  If this
1-25     Act does not receive the vote necessary for immediate effect, this
1-26     Act takes effect September 1, 2001.
