                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the statute of limitations in certain civil proceedings
 1-3     involving the state or other governmental entities.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 3.118, Business and Commerce Code, is
 1-6     amended by adding Subsection (i) to read as follows:
 1-7           (i)  A right of action of this state or a political
 1-8     subdivision of this state, including a county, an incorporated city
 1-9     or town, a navigation district, a municipal utility district, a
1-10     port authority, an entity acting under Chapter 341 Acts of the 57th
1-11     Legislature, Regular Session, 1961 (Article 1187f, Vernon's Texas
1-12     Civil Statutes), a school district, or an entity created under
1-13     Section 52, Article III, or Section 59, Article XVI, Texas
1-14     Constitution, is not barred by this section.  "Navigation District"
1-15     means a navigation district organized under Section 52, Article
1-16     III, or Section 59, Article XVI, Texas Constitution.  "Port
1-17     authority" has the meaning assigned by Section 60.402, Water Code.
1-18     "Municipal utility district" means a municipal utility district
1-19     created under Section 52, Article III, or Section 59, Article XVI,
1-20     Texas Constitution.
1-21           SECTION 2.  This Act takes effect immediately if it is
1-22     enacted, as required by Section 39, Article III, Texas
1-23     Constitution, by a vote of two-thirds of all the members elected to
1-24     each house.  If this Act does not receive the votes required for
 2-1     immediate effect, this Act takes effect on September 1, 2001.
