 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the statute of limitations in certain civil proceedings
 1-9     involving the state or other governmental entities.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Section 3.118, Business & Commerce Code, is
1-12     amended by adding Subsection (i) to read as follows:
1-13           (i)  A right of action of this state or a political
1-14     subdivision of this state, including a county, an incorporated city
1-15     or town, a navigation district, a municipal utility district, a
1-16     port authority, an entity acting under Chapter 54, Transportation
1-17     Code, a school district, or an entity created under Section 52,
1-18     Article III, or Section 59, Article XVI, Texas Constitution, is not
1-19     barred by this section.  "Navigation district" means a navigation
1-20     district organized under Section 52, Article III, or Section 59,
1-21     Article XVI, Texas Constitution.  "Port authority" has the meaning
1-22     assigned by Section 60.402, Water Code.  "Municipal utility
1-23     district" means a municipal utility district created under Section
1-24     52, Article III, or Section 59, Article XVI, Texas Constitution.
1-25           SECTION 2.  This Act takes effect immediately if it is
1-26     enacted, as required by Section 39, Article III, Texas
1-27     Constitution, by a vote of two-thirds of all the members elected to
1-28     each house.  If this Act does not receive the votes required for
1-29     immediate effect, this Act takes effect on September 1, 2001.
