                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the disposition of the optional county road and bridge
 1-3     fee in certain counties.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 502.103, Transportation Code, is amended
 1-6     to read as follows:
 1-7           Sec. 502.103.  DISPOSITION OF OPTIONAL COUNTY ROAD AND BRIDGE
 1-8     FEE.   (a)  Each Monday a county assessor-collector shall apportion
 1-9     the collections for the preceding week for a fee imposed under
1-10     Section 502.172 by:
1-11                 (1)  crediting an amount equal to 97 percent of the
1-12     collections to the county road and bridge fund; and
1-13                 (2)  sending to the department an amount equal to three
1-14     percent of the collections to defray the department's costs of
1-15     administering Section 502.172.
1-16           (b)  During each county fiscal year, the commissioners court
1-17     of a county with a population of more than 2.8 million shall
1-18     allocate funds credited under Subsection (a)(1) for road projects
1-19     in each municipality in the county and in the unincorporated area
1-20     of the county.  The allocation must be made in the same proportion
1-21     that the population of the municipality located in the county or
1-22     the population of the unincorporated area bears to the total
1-23     population of the county.
1-24           SECTION 2.  This Act takes effect September 1, 2001, and
 2-1     applies only to a county fiscal year that begins on or after that
 2-2     date.
