                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the dissemination of certain information relating to a
 1-3     juvenile.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 58.106(d), Family Code, is amended to read
 1-6     as follows:
 1-7           (d)  The department shall [may, if necessary to protect the
 1-8     welfare of the community,] disseminate to the public the
 1-9     information listed under Subsection (c) relating to a juvenile
1-10     offender when notified by a law enforcement agency of this state
1-11     that the law enforcement agency has been issued a directive to
1-12     apprehend the offender or an arrest warrant for the offender or
1-13     that the law enforcement agency is otherwise authorized to arrest
1-14     the offender and that the offender is suspected of having:
1-15                 (1)  committed a felony offense under the following
1-16     provisions of the Penal Code:
1-17                       (A)  Title 5;
1-18                       (B)  Section 29.02; or
1-19                       (C)  Section 29.03; and
1-20                 (2)  fled from arrest or apprehension for commission of
1-21     the offense.
1-22           SECTION 2. This Act takes effect September 1, 2001, and
1-23     applies only to the dissemination of information based on
1-24     notification by a law enforcement agency on or after that date.
