No. 1456 By: Madla 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to the establishment of a pediatric diabetes research 1-11 advisory committee in the Texas Department of Health. 1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-13 SECTION 1. (a) The commissioner of public health, in 1-14 consultation with the Texas Diabetes Council, shall establish a 1-15 pediatric diabetes research advisory committee. 1-16 (b) The pediatric diabetes research advisory committee is 1-17 composed of the chairman of the Texas Diabetes Council or that 1-18 person's designee and not more than 14 additional members appointed 1-19 by the commissioner of public health in consultation with the Texas 1-20 Diabetes Council as follows: 1-21 (1) one or more representatives of the Texas 1-22 Department of Health; 1-23 (2) one or more representatives of the Juvenile 1-24 Diabetes Research Foundation; 1-25 (3) one or more representatives of the American 1-26 Diabetes Association; 1-27 (4) one or more research professionals from academic 1-28 or biomedical research institutions in this state currently 1-29 involved in diabetes research; and 1-30 (5) one or more representatives of the health care 1-31 industry. 1-32 (c) The commissioner of public health shall select members 1-33 of the pediatric diabetes research advisory committee based on the 1-34 members' experience, expertise, or special interest in diabetes 1-35 and: 1-36 (1) ophthalmology; 1-37 (2) pediatric endocrinology; 1-38 (3) child health and development; 1-39 (4) neuropathy; 1-40 (5) genetics; 1-41 (6) cardiology; or 1-42 (7) immunology. 1-43 (d) The commissioner of public health, with recommendations 1-44 from the Texas Diabetes Council, shall select a member of the 1-45 pediatric diabetes research advisory committee to serve as the 1-46 presiding officer of the committee. The presiding officer may not 1-47 be an officer or employee of the state. 1-48 (e) The pediatric diabetes research advisory committee 1-49 shall: 1-50 (1) develop a plan to research pediatric diabetes and 1-51 medical conditions associated with diabetes in this state; 1-52 (2) assess the resources and talent of institutions in 1-53 this state as possible sites for research opportunities; 1-54 (3) analyze the impact of diabetes on the economy of 1-55 this state and on the health of the residents of this state; and 1-56 (4) make recommendations to the legislature and 1-57 governor concerning research programs in pediatric diabetes and 1-58 funding alternatives for the programs. 1-59 (f) The pediatric diabetes research advisory committee shall 1-60 meet at least four times as determined by the presiding officer. A 1-61 professional facilitator with experience in strategic planning 1-62 shall facilitate meetings of the committee. 1-63 (g) A member of the pediatric diabetes research advisory 1-64 committee may not receive compensation for service on the committee 2-1 but is entitled to reimbursement for reasonable and necessary 2-2 travel expenses incurred by the member while conducting the 2-3 business of the committee as provided by general law and the 2-4 General Appropriations Act. 2-5 (h) Not later than December 1, 2002, the commissioner of 2-6 public health shall submit a report prepared by the pediatric 2-7 diabetes research advisory committee to the governor, lieutenant 2-8 governor, and speaker of the house of representatives regarding 2-9 pediatric diabetes that comprehensively addresses the issues listed 2-10 in Subsection (e) of this section. 2-11 SECTION 2. The commissioner of public health shall appoint 2-12 members to the pediatric diabetes research advisory committee not 2-13 later than the 90th day after the effective date of this Act. 2-14 SECTION 3. The pediatric diabetes research advisory 2-15 committee is abolished January 1, 2003. 2-16 SECTION 4. This Act expires September 1, 2003. 2-17 SECTION 5. This Act takes effect immediately if it receives 2-18 a vote of two-thirds of all the members elected to each house, as 2-19 provided by Section 39, Article III, Texas Constitution. If this 2-20 Act does not receive the vote necessary for immediate effect, this 2-21 Act takes effect September 1, 2001. 2-22 * * * * *
