A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to state assistance to school districts for new
1-3 instructional facilities.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 42.158, Education Code, is amended to read
1-6 as follows:
1-7 Sec. 42.158. NEW INSTRUCTIONAL FACILITY ALLOTMENT. (a) A
1-8 school district is entitled to an additional allotment as provided
1-9 by this section for operational expenses associated with opening a
1-10 new instructional facility.
1-11 (b) For the first school year in which students attend a new
1-12 instructional facility, a school district is entitled to an
1-13 allotment of $500 [$250] for each student in average daily
1-14 attendance at the facility. For the second school year in which
1-15 students attend that instructional facility, a school district is
1-16 entitled to an allotment of $500 [$250] for each additional student
1-17 in average daily attendance at the facility.
1-18 (c) For purposes of this section, the number of additional
1-19 students in average daily attendance at a facility is the
1-20 difference between the number of students in average daily
1-21 attendance in the current year at that facility and the number of
1-22 students in average daily attendance at that facility in the
1-23 preceding year.
1-24 (d) [The amount appropriated for allotments under this
2-1 section may not exceed $25 million in a school year. If the total
2-2 amount of allotments to which districts are entitled under this
2-3 section for a school year exceeds the amount appropriated for
2-4 allotments under this section, the commissioner shall reduce each
2-5 district's allotment under this section in the manner provided by
2-6 Section 42.253(h).]
2-7 [(e)] A school district that is required to take action
2-8 under Chapter 41 to reduce its wealth per student to the equalized
2-9 wealth level is entitled to a credit, in the amount of the
2-10 allotments to which the district is entitled under this section,
2-11 against the total amount required under Section 41.093 for the
2-12 district to purchase attendance credits. A school district that is
2-13 otherwise ineligible for state aid under this chapter is entitled
2-14 to receive allotments under this section.
2-15 (e) [(f)] The commissioner may adopt rules necessary to
2-16 implement this section.
2-17 (f) [(g)] In this section, "instructional facility" has the
2-18 meaning assigned by Section 46.001.
2-19 SECTION 2. This Act takes effect September 1, 2001.
