A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the offense of disruption of a class or other school
1-3 activity.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Sections 37.124(a) and (b), Education Code, are
1-6 amended to read as follows:
1-7 (a) A person commits an offense if the person, on school
1-8 property or on public property within 500 feet of school property,
1-9 alone or in concert with others, intentionally disrupts the conduct
1-10 of a class [classes] or other school activity [activities].
1-11 (b) An offense under this section is a Class C misdemeanor,
1-12 unless the person has previously been convicted of an offense under
1-13 this section, in which event the offense is a Class B misdemeanor.
1-14 SECTION 2. Section 37.124(c)(1), Education Code, is amended
1-15 to read as follows:
1-16 (c) In this section:
1-17 (1) "Disrupting the conduct of a class [classes] or
1-18 other school activity [activities]" includes:
1-19 (A) emitting noise of an intensity that prevents
1-20 or hinders the conduct of a class or other school activity
1-21 [classroom instruction];
1-22 (B) enticing or attempting to entice a student
1-23 away from a class or other school activity that the student is
2-1 required to attend;
2-2 (C) preventing or attempting to prevent a
2-3 student from attending a class or other school activity that the
2-4 student is required to attend; [and]
2-5 (D) preventing or hindering entrance to or exit
2-6 from school property during the period beginning one hour before
2-7 commencement of classes for the school day and ending one hour
2-8 after conclusion of classes for the school day, although nothing in
2-9 this subsection shall prevent the legitimate exercise of the rights
2-10 of free speech or assembly under the Texas and U.S. constitutions;
2-11 and
2-12 (E) entering a classroom without the consent of
2-13 either the principal or the teacher and, through either acts of
2-14 misconduct or the use of loud or profane language, disrupting a
2-15 class or other school activity [activities].
2-16 SECTION 3. Section 37.124(c)(4), Education Code, is added to
2-17 read as follows:
2-18 (4) "School activity" includes an activity held on
2-19 school property before or after school.
2-20 SECTION 4. This Act takes effect September 1, 2001.
