No. 1546 77R7971 QS-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the establishment of a diabetes research center at the 1-3 Texas Tech University campus in El Paso. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Chapter 109, Education Code, is amended by adding 1-6 Subchapter E to read as follows: 1-7 SUBCHAPTER E. TEXAS DIABETES RESEARCH CENTER 1-8 Sec. 109.91. DEFINITIONS. In this subchapter: 1-9 (1) "Board" means the board of regents of the Texas 1-10 Tech University System. 1-11 (2) "Center" means the Texas Diabetes Research Center. 1-12 Sec. 109.92. ESTABLISHMENT OF CENTER. (a) The board shall 1-13 establish the Texas Diabetes Research Center for purposes of 1-14 researching issues related to: 1-15 (1) diabetes; and 1-16 (2) conditions associated with that disease. 1-17 (b) The organization, control, and management of the center 1-18 is vested in the board. 1-19 (c) The board shall approve the employment of personnel by 1-20 and the operating budget of the center. An employee of the center 1-21 is an employee of Texas Tech University. 1-22 Sec. 109.93. LOCATION. The board shall select a site for 1-23 the center at the El Paso campus of Texas Tech University. 1-24 Sec. 109.94. RESEARCH AGREEMENTS. The center may enter into 2-1 an agreement or may cooperate with a public or private entity to 2-2 perform the research functions of the center. 2-3 Sec. 109.95. GIFTS AND GRANTS. The board may solicit, 2-4 accept, and administer gifts and grants from any public or private 2-5 source for the use and benefit of the center. 2-6 Sec. 109.96. COORDINATING BOARD SUPERVISION. The center is 2-7 subject to the continuing supervision of the Texas Higher Education 2-8 Coordinating Board under Chapter 61 and to the rules of the 2-9 coordinating board adopted under Chapter 61. 2-10 SECTION 2. The board of regents of the Texas Tech University 2-11 System shall establish the Texas Diabetes Research Center as 2-12 provided by Subchapter E, Chapter 109, Education Code, as added by 2-13 this Act, not later than January 1, 2003. 2-14 SECTION 3. This Act takes effect immediately if it receives 2-15 a vote of two-thirds of all the members elected to each house, as 2-16 provided by Section 39, Article III, Texas Constitution. If this 2-17 Act does not receive the vote necessary for immediate effect, this 2-18 Act takes effect September 1, 2001.
