                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to defense base development authorities.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 378.011, Local Government Code, is
 1-5     amended by amending Subsection (b) and adding Subsection (c) to
 1-6     read as follows:
 1-7           (b)  Section 25.07(a), Tax Code, does not apply [applies] to
 1-8     a leasehold or other possessory interest in real property granted
 1-9     by an authority for a project designated under Section 378.009(a)
1-10     [in the same manner as it applies to a leasehold or other
1-11     possessory interest in real property constituting a project
1-12     described by Section 4B(k), Development Corporation Act of 1979
1-13     (Article 5190.6, Vernon's Texas Civil Statutes)].  Projects are
1-14     exempt from taxation under Section 11.11, Tax Code, for the period
1-15     of such lease or other possessory interest.
1-16           (c)  This subsection and Subsection (b) expire September 1,
1-17     2007.
1-18           SECTION 2.  Subdivision (5), Section 378.001, Local
1-19     Government Code, as added by Chapter 1221, Acts of the 76th
1-20     Legislature, Regular Session, 1999, is amended to read as follows:
1-21                 (5)  "Defense base" means a military installation or
1-22     facility closed or realigned under the Defense Base Closure and
1-23     Realignment Act of 1990 (10 U.S.C. Section 2687 note) and its
1-24     subsequent amendments, a closed military installation or facility
1-25     now operated by a public technical institute as defined by Section
 2-1     61.003, Education Code, and that is located in a county with a
 2-2     population of more than 210,000 and less than 230,000, Ellington
 2-3     Air Force Base, or the former Amarillo Air Force Base.
 2-4           SECTION 3.  This Act takes effect immediately if it receives
 2-5     a vote of two-thirds of all the members elected to each house, as
 2-6     provided by Section 39, Article III, Texas Constitution.  If this
 2-7     Act does not receive the vote necessary for immediate effect, this
 2-8     Act takes effect September 1, 2001.
