                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the Judicial Retirement System of Texas Plan One and
 1-3     the Judicial Retirement System of Texas Plan Two.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter B, Chapter 833, Government Code, is
 1-6     amended by adding Section 833.106 to read as follows:
 1-7           Sec. 833.106.  CREDIT FOR YEAR IN WHICH ELIGIBLE FOR OFFICE.
 1-8     (a)  A member who has not retired may establish service credit in
 1-9     the retirement system for any calendar year during which the
1-10     member:
1-11                 (1)  held an office included in the membership of the
1-12     retirement system; or
1-13                 (2)  was eligible to take the oath for an office
1-14     included in the membership of the retirement system.
1-15           (b)  A member may establish service credit under this section
1-16     by depositing with the retirement system a contribution computed
1-17     for each month of credit claimed at the rate of six percent of the
1-18     member's current monthly salary, plus, if the member does not
1-19     establish credit before the first anniversary of the date of first
1-20     eligibility, interest computed on the basis of the state fiscal
1-21     year at an annual rate of 10 percent from the date of first
1-22     eligibility to the date of deposit.
1-23           SECTION 2.  Subsection (b), Section 834.102, Government Code,
1-24     is amended to read as follows:
1-25           (b)  The retirement system shall increase by 10 percent of
 2-1     the amount of the applicable state salary under Subsection (a) or
 2-2     (d)[,] the annuity of a member who on the effective date of
 2-3     retirement:
 2-4                 (1)  has not been out of judicial office for more than
 2-5     one year; or
 2-6                 (2)  has served as a visiting judge in this state and
 2-7     the first anniversary of the last day of that service has not
 2-8     occurred.
 2-9           SECTION 3.  Section 835.101, Government Code, is amended by
2-10     amending Subsection (a) and adding Subsection (c) to read as
2-11     follows:
2-12           (a)  Except as provided by Subsection (c), each [Each] month
2-13     the payroll officer responsible for paying the state compensation
2-14     of a judicial officer who is a member of the retirement system
2-15     shall deduct from the state compensation of the judicial officer a
2-16     contribution computed at the rate required of a member of the
2-17     employee class of the Employees Retirement System of Texas.
2-18           (c)  A member who accrues 20 years of service credit in the
2-19     retirement system ceases making contributions under this section.
2-20           SECTION 4.  Subchapter B, Chapter 838, Government Code, is
2-21     amended by adding Section 838.106 to read as follows:
2-22           Sec. 838.106.  CREDIT FOR YEAR IN WHICH ELIGIBLE FOR OFFICE.
2-23     (a)  A contributing member may establish service credit in the
2-24     retirement system for any calendar year during which the member:
2-25                 (1)  held an office included in the membership of the
2-26     retirement system; or
 3-1                 (2)  was eligible to take the oath for an office
 3-2     included in the membership of the retirement system.
 3-3           (b)  A member may establish service credit under this section
 3-4     by depositing with the retirement system a contribution computed
 3-5     for each month of credit claimed at the rate of six percent of the
 3-6     member's current monthly salary, plus, if the member does not
 3-7     establish credit before the first anniversary of the date of first

3-11           SECTION 5.  Subsection (b), Section 839.102, Government Code,
3-12     is amended to read as follows:

3-15     (c) the annuity of a member who on the effective date of
3-16     retirement:
3-17                 (1)  has not been out of judicial office for more than
3-18     one year; or

3-20     the first anniversary of the last day of that service has not
3-21     occurred.
3-22           SECTION 6.  This Act takes effect September 1, 2001.
