                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the Judicial Retirement System of Texas Plan One and
 1-3     the Judicial Retirement System of Texas Plan Two.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter B, Chapter 833, Government Code, is
 1-6     amended by adding Section 833.106 to read as follows:
 1-7           Sec. 833.106.  CREDIT FOR YEAR IN WHICH ELIGIBLE FOR OFFICE.
 1-8     (a)  A member who has not retired may establish service credit in
 1-9     the retirement system for any calendar year during which the
1-10     member:
1-11                 (1)  held an office included in the membership of the
1-12     retirement system; or
1-13                 (2)  was eligible to take the oath for an office
1-14     included in the membership of the retirement system.
1-15           (b)  A member may establish credit under this section by
1-16     depositing with the retirement system a contribution computed for
1-17     each month of credit claimed at the rate of six percent of the
1-18     member's current monthly salary, plus, if the member does not
1-19     establish credit before the first anniversary of the date of first
1-20     eligibility, interest computed on the basis of the state fiscal
1-21     year at an annual rate of 10 percent from the date of first
1-22     eligibility to the date of deposit.
1-23           SECTION 2.  Section 835.101, Government Code, is amended by
 2-1     amending Subsection (a) and adding Subsection (c) to read as
 2-2     follows:
 2-3           (a)  Except as provided by Subsection (c), each [Each] month
 2-4     the payroll officer responsible for paying the state compensation
 2-5     of a judicial officer who is a member of the retirement system
 2-6     shall deduct from the state compensation of the judicial officer a
 2-7     contribution computed at the rate required of a member of the
 2-8     employee class of the Employees Retirement System of Texas.
 2-9           (c)  A member who accrues 20 years of service credit in the
2-10     retirement system ceases making contributions under this section.
2-11                 SECTION 3.  Section 834.102, Government Code, is
2-12     amended by amending Subsection (b) to read as follows:
2-13                 (b)  The retirement system shall increase by 10 percent
2-14     of the amount of the applicable state salary under Subsection (a)
2-15     or (d) the annuity of a member who on the effective date of
2-16     retirement:
2-17                 (1)  has not been out of judicial office for more than
2-18     one year; or
2-19                 (2)  has served as a visiting judge in this state and
2-20     the first anniversary of the last day of that service has not
2-21     occurred.
2-22           SECTION 4.  Subchapter B, Chapter 838, Government Code, is
2-23     amended by adding Section 838.106 to read as follows:
2-24           Sec. 838.106.  CREDIT FOR YEAR IN WHICH ELIGIBLE FOR OFFICE.
2-25     (a)  A contributing member may establish service credit in the
2-26     retirement system for any calendar year during which the member:
 3-1                 (1)  held an office included in the membership of the
 3-2     retirement system; or
 3-3                 (2)  was eligible to take the oath for an office
 3-4     included in the membership of the retirement system.
 3-5     (b)  A member may establish credit under this section by depositing
 3-6     with the retirement system a contribution computed for each month
 3-7     of credit claimed at the rate of six percent of the member's
 3-8     current monthly salary, plus, if the member does not establish
 3-9     credit before the first anniversary of the date of first
3-10     eligibility, interest computed on the basis of the state fiscal
3-11     year at an annual rate of 10 percent from the date of first
3-12     eligibility to the date of deposit.
3-13           SECTION 5.  Section 839.102, Government Code, is amended to
3-14     read as follows:
3-15           Sec. 839.102.  SERVICE RETIREMENT ANNUITY.  (a)  Except as
3-16     provided by Subsections (b) and (c), the standard service
3-17     retirement annuity is an amount equal to 50 percent of the state
3-18     salary, as adjusted from time to time, being paid [at the time the
3-19     member retires] to a judge of a court of the same classification as
3-20     the last court to which the retiring member was elected or
3-21     appointed.
3-22           (b)  The retirement system shall increase by 10 percent of
3-23     the amount of the applicable state salary under Subsection (a) or
3-24     (c) the annuity of a member who on the effective date of
3-25     retirement:
3-26                 (1)  has not been out of judicial office for more than
 4-1     one year; or
 4-2                 (2)  has served as a visiting judge in this state and
 4-3     the first anniversary of the last day of that service has not
 4-4     occurred.
 4-5           (c)  The standard service retirement annuity of a person
 4-6     qualifying for retirement under Section 839.101(b) is an amount
 4-7     computed as a percentage of the state salary, as adjusted from time
 4-8     to time, being paid [at the time the member retires] to a judge of
 4-9     a court of the same classification as the last court to which the
4-10     retiring member was elected or appointed, according to the
4-11     following schedule:
4-12                  age at retirement           percentage of state salary
4-13           at least 60 but less than 61              40 percent
4-14           at least 61 but less than 62              41.7 percent
4-15           at least 62 but less than 63              43.6 percent
4-16           at least 63 but less than 64              45.6 percent
4-17           at least 64 but less than 65              47.7 percent.
4-18           SECTION 5.  This Act takes effect September 1, 2001.
