1-9 A BILL TO BE ENTITLED
1-10 AN ACT
1-11 relating to the Judicial Retirement System of Texas Plan One and
1-12 the Judicial Retirement System of Texas Plan Two.
1-13 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-14 SECTION 1. Subchapter B, Chapter 833, Government Code, is
1-15 amended by adding Section 833.106 to read as follows:
1-16 Sec. 833.106. CREDIT FOR YEAR IN WHICH ELIGIBLE FOR OFFICE.
1-17 (a) A member who has not retired may establish service credit in
1-18 the retirement system for any calendar year during which the
1-19 member:
1-20 (1) held an office included in the membership of the
1-21 retirement system; or
1-22 (2) was eligible to take the oath for an office
1-23 included in the membership of the retirement system.
1-24 (b) A member may establish service credit under this section
1-25 by depositing with the retirement system a contribution computed
1-26 for each month of credit claimed at the rate of six percent of the
1-27 member's current monthly salary, plus, if the member does not
1-28 establish credit before the first anniversary of the date of first
1-29 eligibility, interest computed on the basis of the state fiscal
1-30 year at an annual rate of 10 percent from the date of first
1-31 eligibility to the date of deposit.
1-32 SECTION 2. Subsection (b), Section 834.102, Government Code,
1-33 is amended to read as follows:
1-34 (b) The retirement system shall increase by 10 percent of
1-35 the amount of the applicable state salary under Subsection (a) or
1-36 (d)[,] the annuity of a member who on the effective date of
1-37 retirement:
1-38 (1) has not been out of judicial office for more than
1-39 one year; or
1-40 (2) has served as a visiting judge in this state and
1-41 the first anniversary of the last day of that service has not
1-42 occurred.
1-43 SECTION 3. Section 835.101, Government Code, is amended by
1-44 amending Subsection (a) and adding Subsection (c) to read as
1-45 follows:
1-46 (a) Except as provided by Subsection (c), each [Each] month
1-47 the payroll officer responsible for paying the state compensation
1-48 of a judicial officer who is a member of the retirement system
1-49 shall deduct from the state compensation of the judicial officer a
1-50 contribution computed at the rate required of a member of the
1-51 employee class of the Employees Retirement System of Texas.
1-52 (c) A member who accrues 20 years of service credit in the
1-53 retirement system ceases making contributions under this section.
1-54 SECTION 4. Subchapter B, Chapter 838, Government Code, is
1-55 amended by adding Section 838.106 to read as follows:
1-56 Sec. 838.106. CREDIT FOR YEAR IN WHICH ELIGIBLE FOR OFFICE.
1-57 (a) A contributing member may establish service credit in the
1-58 retirement system for any calendar year during which the member:
1-59 (1) held an office included in the membership of the
1-60 retirement system; or
1-61 (2) was eligible to take the oath for an office
1-62 included in the membership of the retirement system.
1-63 (b) A member may establish service credit under this section
1-64 by depositing with the retirement system a contribution computed
2-1 for each month of credit claimed at the rate of six percent of the
2-2 member's current monthly salary, plus, if the member does not
2-3 establish credit before the first anniversary of the date of first
2-4 eligibility, interest computed on the basis of the state fiscal
2-5 year at an annual rate of 10 percent from the date of first
2-6 eligibility to the date of deposit.
2-7 SECTION 5. Subsection (b), Section 839.102, Government Code,
2-8 is amended to read as follows:
2-9 (b) The retirement system shall increase by 10 percent of
2-10 the amount of the applicable state salary under Subsection (a) or
2-11 (c) the annuity of a member who on the effective date of
2-12 retirement:
2-13 (1) has not been out of judicial office for more than
2-14 one year; or
2-15 (2) has served as a visiting judge in this state and
2-16 the first anniversary of the last day of that service has not
2-17 occurred.
2-18 SECTION 6. This Act takes effect September 1, 2001.
