                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the expunction of arrest records and files based on an
 1-3     acquittal.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 2(a), Article 55.02, Code of Criminal
 1-6     Procedure, is amended to read as follows:
 1-7           (a)  A person who is entitled to expunction of records and
 1-8     files under Article 55.01(a) [55.01(a)(1)(B) or 55.01(a)(2)] or a
 1-9     person who is eligible for expunction of records and files under
1-10     Article 55.01(b) may file an ex parte petition for expunction in a
1-11     district court for the county in which the person was arrested or
1-12     in the county where the offense was alleged to have occurred.
1-13           SECTION 2. This Act takes effect September 1, 2001, and
1-14     applies to the expunction of records and files relating to an
1-15     arrest regardless of whether the arrest occurred before, on, or
1-16     after the effective date of this Act.
