                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to contracts with the Texas Department of Transportation
 1-3     for the removal of certain property from a state highway.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter B, Chapter 472, Transportation Code,
 1-6     is amended by adding Section 472.015 to read as follows:
 1-7           Sec. 472.015.  CONTRACTS FOR THE REMOVAL OF PROPERTY.  In
 1-8     contracting with a private business for the removal of personal
 1-9     property from the right-of-way or roadway of the state highway
1-10     system, the department may:
1-11                 (1)  use a purchasing method described in Chapter 2156,
1-12     Government Code;
1-13                 (2)  include the removal work in a contract entered
1-14     into under Chapter 223; or
1-15                 (3)  select a business based on an evaluation of the
1-16     experience of the business and the quality of the business's
1-17     equipment and services.
1-18           SECTION 2.  This Act takes effect immediately if it receives
1-19     a vote of two-thirds of all the members elected to each house, as
1-20     provided by Section 39, Article III, Texas Constitution.  If this
1-21     Act does not receive the vote necessary for immediate effect, this
1-22     Act takes effect September 1, 2001.
