                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to removing the Texas Juvenile Probation Commission from
 1-3     the list of agencies considered to be health and human services
 1-4     agencies generally subject to the authority of the Health and Human
 1-5     Services Commission.
 1-6           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-7           SECTION 1.  Subdivision (4), Section 531.001, Government
 1-8     Code, as amended by Chapters 7 and 1460, Acts of the 76th
 1-9     Legislature, Regular Session, 1999, is amended to read as follows:
1-10                 (4)  "Health and human services agencies" includes the:
1-11                       (A)  Interagency Council on Early Childhood
1-12     Intervention;
1-13                       (B)  Texas Department on Aging;
1-14                       (C)  Texas Commission on Alcohol and Drug Abuse;
1-15                       (D)  Texas Commission for the Blind;
1-16                       (E)  Texas Commission for the Deaf and Hard of
1-17     Hearing;
1-18                       (F)  Texas Department of Health;
1-19                       (G)  Texas Department of Human Services;
1-20                       (H)  [Texas Juvenile Probation Commission;]
1-21                       [(I)]  Texas Department of Mental Health and
1-22     Mental Retardation;
1-23                       (I) [(J)]  Texas Rehabilitation Commission;
1-24                       (J) [(K)]  Department of Protective and
1-25     Regulatory Services; [and]
 2-1                       (K) [(L)]  Children's Trust Fund of Texas
 2-2     Council; and [.]
 2-3                       (L)  Texas Health Care Information Council.
 2-4           SECTION 2.  Subsection (b), Section 2166.553, Government
 2-5     Code, is amended to read as follows:
 2-6           (b)  In this section, "health and human services agency"
 2-7     means the:
 2-8                 (1)  Interagency Council on Early Childhood
 2-9     Intervention Services;
2-10                 (2)  Texas Department on Aging;
2-11                 (3)  Texas Commission on Alcohol and Drug Abuse;
2-12                 (4)  Texas Commission for the Blind;
2-13                 (5)  Texas Commission for the Deaf and Hard of Hearing
2-14     [Impaired];
2-15                 (6)  Texas Department of Health;
2-16                 (7)  Texas Department of Human Services;
2-17                 (8)  [Texas Juvenile Probation Commission;]
2-18                 [(9)]  Texas Department of Mental Health and Mental
2-19     Retardation;
2-20                 (9) [(10)]  Texas Rehabilitation Commission; and
2-21                 (10) [(11)]  Department of Protective and Regulatory
2-22     Services.
2-23           SECTION 3.  Subsection (b), Section 132.003, Human Resources
2-24     Code, is amended to read as follows:
2-25           (b)  In this section, "health and human services agencies"
2-26     includes the:
 3-1                 (1)  Interagency Council on Early Childhood
 3-2     Intervention Services;
 3-3                 (2)  Texas Department on Aging;
 3-4                 (3)  Texas Commission on Alcohol and Drug Abuse;
 3-5                 (4)  Texas Commission for the Blind;
 3-6                 (5)  Texas Commission for the Deaf and Hard of Hearing
 3-7     [Impaired];
 3-8                 (6)  Texas Department of Health;
 3-9                 (7)  Texas Department of Human Services;
3-10                 (8)  [Texas Juvenile Probation Commission;]
3-11                 [(9)]  Texas Department of Mental Health and Mental
3-12     Retardation;

3-16           SECTION 4.  Section 141.0405, Human Resources Code, is
3-17     repealed.
3-18           SECTION 5.  This Act takes effect September 1, 2001.
