No. 1609 1-2 (In the Senate - Filed March 9, 2001; March 14, 2001, read 1-3 first time and referred to Committee on Natural Resources; 1-4 May 2, 2001, reported favorably by the following vote: Yeas 6, 1-5 Nays 0; May 2, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to outdoor burning under the Texas Clean Air Act. 1-9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-10 SECTION 1. Section 382.018, Health and Safety Code, is 1-11 amended to read as follows: 1-12 Sec. 382.018. OUTDOOR BURNING OF WASTE AND COMBUSTIBLE 1-13 MATERIAL. (a) The commission by rule may control and prohibit the 1-14 outdoor burning of waste and combustible material and may include 1-15 requirements concerning the particular method to be used to control 1-16 or abate the emission of air contaminants resulting from that 1-17 burning. 1-18 (b) The commission by rule shall authorize residents of a 1-19 residential subdivision to consolidate for on-site burning at one 1-20 location within the subdivision and to burn at that location waste 1-21 from individual residents' properties that consists of trees, 1-22 brush, and other plant growth. 1-23 SECTION 2.
