                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to Texas Education Agency guidelines for certain
 1-3     after-school and summer programs.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter B, Chapter 7, Education Code, is
 1-6     amended by adding Section 7.025 to read as follows:
 1-7           Sec. 7.025.  GUIDELINES FOR CERTAIN AFTER-SCHOOL AND SUMMER
 1-8     PROGRAMS.  (a)  In this section, "student at risk of dropping out
 1-9     of school" has the meaning assigned by Section 29.081.
1-10           (b)  The agency shall adopt guidelines for effectively  using
1-11     money from public and private sources in after-school and summer
1-12     programs for students at risk of dropping out of school or students
1-13     identified as likely not to be promoted to the next grade level.
1-14           (c)  In developing guidelines under Subsection (b), the
1-15     agency shall:
1-16                 (1)  use data from current educational research on
1-17     effective after-school programs;
1-18                 (2)  use agency data from after-school programs for
1-19     middle school students; and
1-20                 (3)  consult:
1-21                       (A)  federal entities;
1-22                       (B)  other state agencies;
1-23                       (C)  local entities, including local parks and
1-24     recreation departments;
 2-1                       (D)  institutions of higher education; and
 2-2                       (E)  any other entities the agency determines
 2-3     would be helpful.
 2-4           (d)  The agency shall conduct research on evaluation
 2-5     instruments to use in evaluating the effectiveness of after-school
 2-6     and summer programs and determine which instruments are effective.
 2-7           (e)  The agency shall post on the agency's Internet website:
 2-8                 (1)  guidelines adopted under this section; and
 2-9                 (2)  the type of evaluation instruments that the agency
2-10     recommends using in evaluating the effectiveness of after-school
2-11     and summer programs.
2-12           SECTION 2.  This Act takes effect immediately if it receives
2-13     a vote of two-thirds of all the members elected to each house, as
2-14     provided by Section 39, Article III, Texas Constitution.  If this
2-15     Act does not receive the vote necessary for immediate effect, this
2-16     Act takes effect September 1, 2001.
