No. 1625 1-2 (In the Senate - Filed March 9, 2001; March 14, 2001, read 1-3 first time and referred to Committee on Education; April 17, 2001, 1-4 reported favorably by the following vote: Yeas 8, Nays 0; 1-5 April 17, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to Texas Education Agency guidelines for certain 1-9 after-school and summer programs. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Subchapter B, Chapter 7, Education Code, is 1-12 amended by adding Section 7.025 to read as follows: 1-13 Sec. 7.025. GUIDELINES FOR CERTAIN AFTER-SCHOOL AND SUMMER 1-14 PROGRAMS. (a) In this section, "student at risk of dropping out 1-15 of school" has the meaning assigned by Section 29.081. 1-16 (b) The agency shall adopt guidelines for effectively using 1-17 money from public and private sources in after-school and summer 1-18 programs for students at risk of dropping out of school or students 1-19 identified as likely not to be promoted to the next grade level. 1-20 (c) In developing guidelines under Subsection (b), the 1-21 agency shall: 1-22 (1) use data from current educational research on 1-23 effective after-school programs; 1-24 (2) use agency data from after-school programs for 1-25 middle school students; and 1-26 (3) consult: 1-27 (A) federal entities; 1-28 (B) other state agencies; 1-29 (C) local entities, including local parks and 1-30 recreation departments; 1-31 (D) institutions of higher education; and 1-32 (E) any other entities the agency determines 1-33 would be helpful. 1-34 (d) The agency shall conduct research on evaluation 1-35 instruments to use in evaluating the effectiveness of after-school 1-36 and summer programs and determine which instruments are effective. 1-37 (e) The agency shall post on the agency's Internet website: 1-38 (1) guidelines adopted under this section; and 1-39 (2) the type of evaluation instruments that the agency 1-40 recommends using in evaluating the effectiveness of after-school 1-41 and summer programs. 1-42 SECTION 2. This Act takes effect immediately if it receives 1-43 a vote of two-thirds of all the members elected to each house, as 1-44 provided by Section 39, Article III, Texas Constitution. If this 1-45 Act does not receive the vote necessary for immediate effect, this 1-46 Act takes effect September 1, 2001. 1-47 * * * * *
