 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the applicability of provisions governing the powers of
1-11     property owners' associations concerning restrictive covenants in
1-12     certain subdivisions.
1-13           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-14           SECTION 1.  Subsection (a), Section 204.002, Property Code,
1-15     is amended to read as follows:
1-16           (a)  This chapter applies only to a residential real estate
1-17     subdivision, excluding a condominium development governed by Title
1-18     7, Property Code, that is located in whole or in part:
1-19                 (1)  in a county with a population of three million or
1-20     more; or
1-21                 (2)  in a county with a population of 250,000 or more
1-22     that is adjacent to a county having a population of three million
1-23     or more and that borders the Gulf of Mexico [in a county with a
1-24     population of 2.8 million or more].
1-25           SECTION 2.  This Act takes effect September 1, 2001.
