 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to audits of the promotion and development fund of a
 1-9     navigation district.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Subsection (c), Section 60.204, Water Code, is
1-12     amended to read as follows:
1-13           (c)  The county auditor shall exercise his usual supervision
1-14     and control to assure that the commission sets aside no more than
1-15     five percent of its gross income from operations in each calendar
1-16     year in the promotion and development fund.  The county auditor may
1-17     [shall not] audit disbursements from the fund and [but] shall be
1-18     entitled to a monthly statement showing the:
1-19                 (1)  date of each disbursement from the fund;
1-20                 (2)  amount disbursed;
1-21                 (3)  person or concern to whom disbursed; and
1-22                 (4)  general purpose of each disbursement.
1-23           SECTION 2.  This Act takes effect immediately if it receives
1-24     a vote of two-thirds of all the members elected to each house, as
1-25     provided by Section 39, Article III, Texas Constitution.  If this
1-26     Act does not receive the vote necessary for immediate effect, this
1-27     Act takes effect September 1, 2001.
