A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the election of trustees in certain school districts. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Subchapter C, Chapter 11, Education Code, is 1-5 amended by adding Sec. 11.0531 to read as follows: 1-6 Sec. 11.0531. SINGLE-MEMBER DISTRICTS IN CERTAIN SCHOOL 1-7 DISTRICTS. (a) This section applies to a school district with an 1-8 average daily attendance of more than 40,000 and less than 60,000 1-9 that elects trustees from single-member trustee districts and is 1-10 located wholly within a county with a population of more than 1-11 550,000 that shares a border with a foreign country. 1-12 (b) A district to which this section applies shall elect 1-13 five trustees from single-member trustee districts and two trustees 1-14 at large. 1-15 (c) The board shall divide the school district into five 1-16 trustee districts and shall number each trustee district. The 1-17 trustee districts must be compact and contiguous and must be as 1-18 nearly as practicable of equal population. Trustee districts must 1-19 be drawn not later than the 90th day before the date trustees are 1-20 elected from the new single-member districts. 1-21 (d) Residents of each trustee district are entitled to elect 1-22 one trustee to the board. A trustee elected to represent a trustee 1-23 district at the first election of trustees under this section must 2-1 be a resident of the district the trustee represents not later 2-2 than: (1) the 90th day after the date election returns are 2-3 canvassed; or (2) the 60th day after the date of a final judgment 2-4 in an election contest filed concerning that trustee district. 2-5 After the first election of trustees under this section, a 2-6 candidate for trustee representing a single-member trustee district 2-7 must be a resident of the district the candidate seeks to 2-8 represent. A person appointed to fill a vacancy in a trustee 2-9 district must be a resident of that trustee district. A trustee 2-10 vacates the office if the trustee fails to move into the trustee 2-11 district the trustee represents within the time provided by this 2-12 subsection or ceases to reside in the district the trustee 2-13 represents. 2-14 (e) An at large candidate must be a resident of the 2-15 district. An at large trustee vacates the office if the trustee 2-16 ceases to reside in the district. 2-17 (f) At the first election at which trustees are elected 2-18 under this section, all positions on the board shall be filled. 2-19 The trustees then elected shall draw lots of staggered terms as 2-20 provided by Section 11.059. 2-21 (g) This section expires January 1, 2005. 2-22 SECTION 2. The board of trustees of a district to which this 2-23 Act applies shall first draw single-member districts under this Act 2-24 not later than the 90th day before the date for election of 2-25 trustees in the district in 2002. 2-26 SECTION 3. This Act take effect immediately if it receives a 3-1 vote of two-thirds of all the members elected to each house, as 3-2 provided by Section 39, Article III, Texas Constitution. If this 3-3 Act does not receive the vote necessary for immediate effect, this 3-4 Act takes effect September 1, 2001.
