                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to allowing a closed session for a school board to
 1-3     consider student matters.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 551.082, Government Code is amended to
 1-6     read as follows:
 1-7           Section 551.082.  School Children; School District Employees;
 1-8     Disciplinary Matter or Complaint.  (a)  This chapter does not
 1-9     require a school board to conduct an open meeting to deliberate in
1-10     a case:
1-11           (1)  involving [discipline of] a public school child; or
1-12           (2)  in which a complaint or charge is brought against an
1-13     employee of the school district by another employee and the
1-14     complaint or charge directly results in a need for a hearing.
1-15     (b)  Subsection (a) does not apply if an open hearing is requested
1-16     in writing by a parent or guardian of the child or by the employee
1-17     against whom the complaint or charge is brought.
1-18           SECTION 2.  (a)  This Act takes effect in the 2001-02 school
1-19     year.
1-20           (b)  This Act takes effect immediately if it receives a vote
1-21     of two-thirds of all the members elected to each house, as provided
1-22     by Section 39, Article III, Texas Constitution.  If this Act does
1-23     not receive the vote necessary for immediate effect, this Act takes
 2-1     effect September 1, 2001.
